Recommendations Specialist Schools - London / South East.

Hello,

We are currently in the process of seeking Specialist Schools both (Independent and Non-Independent). DD has a diagnosis of ASD and is currently in attendance at a Mainstream School however, school have said that they cannot meet her needs, this we were made aware of prior to an early Interim Review of her EHCP.

It was agreed that a Specialist School setting would be more suited to her in order to assist with her SEND accordingly. We are also currently in the process of preparing an Appeal as we have decided to take her case to Tribunal to appeal the overall contents of DD’s EHCP as well as the institution (school) that she should go to based on her SEND but also that we wished to be named on her EHCP. As part of the Appeal process the LA have already commenced consultations with those schools that we wished be approached and so far the schools have all come back with rejections. Apart from the fact that many of these schools have already reached capacity and cannot take on anymore children (even if the LA were to force them to take; if the schools are Section 41 schools) we strongly feel that DD’s EHCP could also be playing a major part in that it is so badly written and the wording throughout is very unspecific in many areas. Our Solicitor has also confirmed our suspicions and so things are just really incredibly frustrating at this moment in time.

I was therefore wondering and would be most grateful, if anyone may kindly provide recommendations for both Independent and Non-Independent Schools within the London or South East area preferably schools with a specialty in working with children with ASD.

Being full is not defined in law, and on its own being ‘full’ is not enough of a reason to refuse to name your preference. The LA has to prove the school is so full admitting DF is incompatible. The bar for that is high, higher than an “adverse effect”, “impact on” or “prejudicial to”. As you say, unless the school is wholly independent the LA can, and must, name your preference even if the school object.
