How to break deadlock

Child diagnosed global delay at 3 (Jan 2020) with delays in multiple areas.

Covid happened, no SALT, OT nor specialist nurse.

EHCP awarded January 2021. Review needed by paed but was on an 18 month watch and wait and not due until July 2021, covid backlogs stopped that happening.

Started school Sept 2021 and removed from paed list and told to re-refer for school age services.

Child under 3 different therapy services and self-funded OT as well as having an EHCP. School sent new referral for paediatric review.

Took 4 months to receive the rejection for that referral due to a slight error in paperwork and lack of evidence that he actually needs a review. I'm not allowed to just supply the corrected single sheet of paperwork nor extra evidence. They won't speak to the different health services he's under for their fairly unanimous views. It all has to be sent via a school again which realistically means a 6 month delay. It also relies upon when those services get round to providing their reports which some take a couple of weeks, others many months.

A different referral was sent for a key need service May 2021, assured by service they had it Sept 2021. Chased up early May 2022 to be told they don't have it. Took 2.5 months and a formal complaint to get somewhere. They finally got in touch and have said they can't really help beyond monitoring until he's had a paediatric review as it's important for how they can support him. They don't necessarily need the diagnosis but an indication of what it is believed to be.

Took him to the GP for a piece of paperwork to be filled in, which they had lost and could not do. Whilst there they asked when he's due to be reviewed by paediatrician as the very obvious neurodevelopmental condition was evident in the 10 minutes with a completely unknown GP. They aren't allowed to submit any evidence, ie their observations, to paediatrics to support the referral.

So said child at nearly 6 is not allowed a Paediatrician review, he can't access the support he needs for a key need without the Paediatrician review, the medical professionals who see and work with him aren't allowed to support the referral evidence wise because they aren't school.

Any tips on how to get out of this mess? I have complained to PALS and the CEO which isn't proving overly helpful.

Would a reassessment of needs help? Then if the LA agree to the reassessment request the necessary assessments via that.

Alternatively, a different trust’s paediatrics may have different referral process, so asking for a referral to a different trust may get round the problem of HCPs already involved not being able to support the referral.

I would also ask how EHE DC are referred. You could complain to the designated medical officer/designated clinical officer too.

I'm not sure he'd qualify for a reassessment of needs, his ehcp is 18 months and I don't think his needs have changed.

I will have a look into the neighbouring trust though, that sounds feasible!
