Does any one on here recieve the disability element from universal credit?
If so, did they back date it?
My daughters been on DLA since 2020 and never received this when she should of been getting it this whole time.
A job worker said in my journal that he will award it from the earliest date the award took place. Which was feb 2020? She then got higher element last October.

Will this be backdated to that far behind?

Once you do a change of circumstances to notify them your daughter gets DLA you should receive the element in your next UC payment within that assessment period but you would need to ask for it to go to decision marker for it to be backdated as it out with the assessment period. I’m sure when my daughter was awarded they stated as we notified them within a month of her being awarded the DLA they backdated it to date she started receiving DLA. You can ask for it to be backdated and explain your reasoning for not notifying them sooner and see what they decide. Good luck

They knew she was getting it from 2020, they didn't pay it.
I didn't know about this either so I didn't know to report Octobers change either. (Although I have let them know now and I said she should of been getting it )

She is on the highest mobility and allowance. What do universal credit give you extra monthly? Is it just a extra small amount?

The disabled child element is £132.89, and the severely disabled child element for those in receipt of HRC is £414.88.

It will have to go to a decision maker and you should get the lower rate backdated since you told them of the change at the time, however you may not get the higher amount backdated to October because you didn’t notify them of the change before now.

I don't think I'll get the higher amount as I'm out of work even tho she is on highest rate on dla

That works out roughly £30 a week that isn't too bad and anything helps

Does hrc mean highest rate care ? I was thinking of hmr work for some reason then 🙄

So she may get the 400 a month as she has highest rate care element?

It was their error in the first place so I didn't even acknowledge she should recieve this.
There for I knew nothing about letting them know her care changed - so in a way that's their fault too, all I have said is -


We (my daughter and I) should have been in receipt of the 132 a month from 2020 as UC knew when she had started receiving middle rate care.
Will this 132 be backdated from when her claim started?
Also As of October as you know she became in receipt of the highest mobility and highest component as of her condition, which I assume is HRC which then changes to £414? Will this also be backdated from October ? As it isn’t my fault no one added this to my claim in the beginning/ the first place? Thanks for any help
If not is there someone I can challenge about the issue

Yes, HRC is high rate care.

Whether you are working or not does not affect eligibility for the disabled child element or severely disabled child element. It is added to the claim just like other elements and 55p in every pound of your earnings above the work allowance reduce the UC award you receive.

You will be able to ask for a mandatory reconsideration and then appeal any decision.

@someadvice20 You should have a look through your journal to 2020 as you should see there when you notified them and write a journal message asking for it all to be backdated to when your daughter started receiving DLA. Highlight to them to look at your journal as you’ve proof they were notified. State it’s been their error you supplied them with the information at the correct time but they didn’t apply the extra element.

They also confirmed In a message a few days ago they knew she's been in receipt of it since February 2020

The same happened with me I have been a carer since before claiming universal credit but I wasn’t aware of the carers element and they are backdating it from 27/10/2020 because they were aware I was a carer before I had any payments from them I’m still waiting to hear how much they are backdating though

@someadvice20 i got our payment 3 days after the letter was attached to my journal. That’s was back in December so wasn’t really long at all and I could see all the previous statement amount had changed to include the extra element

My son was awarded Dla last week hrc, lrm I’ve requested universal credit backdate the disability element from they day I made the claim they said they have sent it to a decision maker is this normal and did you guys get it backdated after it went to decision maker?

Yes, it will be backdated. You will receive the disabled child element of £132.89.

Hi wonder if anyone can help me once your child has been awarded dla how do I update universal credit please gone to report a change then what do I do I don't know what the change is under left a million messages in journal and can't get a reply from anyone at universal credit can anyone help please

@Xrachxx its under the people that live with you section that you put the change under as when you click on child details it will give ask if they get DLA. Select the level and input the date of change from the date the DLA rate started. So this means they should back at it. I would then leave journal message asking it to be sent to decision marker so it backdated to start of the DLA award. You should get element in next payment but could be a few weeks longer for previous months to be backdated. Hope this info helps
