Hi all I have 3 dc with sen but the 9 year old is who this is about

For the past year and a half his behaviour has gotten worse. He will hit out at teachers and classroom assistants. He wrecks school property. He hits and kicks other students. I am constantly being called in to school for meetings about his behaviour. I was called in last week and they've said hes only going to be allowed in for 2 hours a day going forward (Mainstream school btw)

Im at a loss what to do with him. Because of my other dcs also being on the spectrum I always have a full diary of appointments. I cant, and dont have time to, collect him from school every day because I will not be available

I have spoken to our social worker about this and she said its unlawful to not provide him with his education but she can see why its happening. Does anyone have any advice about what to do next?

That is illegal. Tell them they will have to formally exclude him with all the official paperwork that includes (it’s not actual a bad thing the formal exclusion as it provides evidence of his difficulties)

Does he have a diagnosis? EHCP plan? What support systems have they already got in place?

WhatTheWhoTheWhatThe is right, the school are illegally excluding DS. Don’t allow them to continue to, inform them DS will be attending full time unless you are given formal exclusion paperwork. Then don’t pick him up early unless they formally exclude. Don’t worry if they do exclude, there is procedure to follow, the school will be held accountable, you can challenge the exclusions and it gives you evidence they aren’t meeting DS’s needs.

Alongside this complain to the LA. The LA have ultimate responsibility for ensuring DS receives a suitable, full time education. If DS cannot attend school (for whatever reason including because the school placement isn’t suitable for DS’s needs) the LA must provide alternative education. If the LA refuse to do this you can look to begin Judicial Review proceedings. If you need to go down this route SOSSEN can help with a pre-action letter.

Does DS have an EHCP? If so, ask for an early review. If he doesn’t apply for one, IPSEA have a model letter you can use.

When was DS last assessed by EP, SALT, OT, psychiatrist or clinical psychologist?

Have you asked the LA for school transport?

Thanks for your replies. He has a proposed statement of needs but nothing set in stone yet

The school is only 5 minutes from us so he doesn't need transport

He has been assessed by the school psychologist but nothing from SALT or OT

Are you in NI? If so, have you spoken to SENAC?

I am in NI. I haven't spoke to SENAC because I haven't heard of them lol
