Dla mobility appeal?

Hi all,
My son who is nearly 5 has been diagnosed with-
ASD
Global development delay
Significant speech and language delay
PICA
Constipation
Poor danger awareness
Difficulties with toilet training
On the renewal we was awarded HRC which he has had since the age of 2 and low rate mobility now due to him turning 5 next month. I asked them to re look at their decision on the mobility side of things as I think and have been told under the SMI law he should be entitled to HRM. We was turned down with the DWPs reason of “he doesn’t need substantially more supervision than a child of the same age with a disability” which is ridiculous because he does. He is severely mentally/socially impaired. He has very challenging and disruptive behaviour problems, has massive melt downs hit/kicks/scratches, anyone near him or himself, refusal to walk. He has hyper sensitive vestibular problems and poor balance. He doesn’t communicate or have any understanding. He doesn’t make conscious decisions or understand what’s going on around him. I’ve written my appeal and sent lots of evidence in with it. I was just wondering if anyone’s been through anything similar. If so what happened and how long did it all take?

Sorry I made a mistake on the DWPs decision part I was suppose to say their reason was “he doesn’t need substantially more supervision than a child of the same age WITHOUT a disability not with Blush

Hi, sorry to jump on this thread, but this sounds the same as my Son, he is 6 next Friday an has had high rate care since he was 3, and low rate mobility since he was 5 last year. I just put in a Change Of Circumstances in January.. still waiting to hear back. My son is awaiting diagnosis for ASD, ADHD, PDA and he has Hypermobility. I’m unsure from reading everyone’s messages what our outcome could be. Could I be nosey and ask if yours ever came back accepted? Thanks

Yes, I have done a tribunal for both of my children for exactly this and won both times. You need to get some supporting statements. I had the GP write one for my ds stating that he had SMI and describing his challenging behaviour. For my dd the school deputy wrote something for me. It is worth challenging it as many people win and you have nothing to lose.

@cansu if you don’t mind me asking did your ds have a diagnosis at the time when GP wrote that statement. I’m always afraid the GP will refuse if no diagnosis. He has a Paeds dr could he do it? The Paeds did write a letter to council for us to get a shower as he has no awareness and tries to climb bathroom walls when bathing him etc. Thanks so much for any advice.

He has had a diagnosis since he was three. He is non verbal and very severely impaired so there has never been any doubt. The peads dr could definitely do it. I think just choose someone who knows the struggles and is sympathetic. With dd the dr doesn't really know her that well, so I asked someone at her school instead.
