Hey if anyone could help or give advise I would be very great full

My son has a ehcp he only gets given 1hour of school a day as they say there ‘settling him in’ he is now in year 1 and loves going to school and hard to get to come home somedays. He has asd and I feel he is not being supported enough by his school he has a 1-1 ta/dinner lady but I feel this is not enough for my son and they’re saying aswell there not doing enough for him I asked the school if he could have a 1-1 that has a understanding in autism that would meet his needs that you can’t they told me no and that no mainstream school does this. My son has accepted this to be his school and loves going here.

Trained ASD specialist 1:1's can be provided in MS, but whether DS' 1:1 will be depends on his EHCP. What does DS' EHCP state about the number of hours, experience and qualifications of the 1:1? Is section F detailed, specific and quantified, or is it vague with phrases such as "access to" "or equivalent" "would benefit from".

If the training and qualifications are specified in the EHCP the 1:1 must have them. If they don't you can complain - both to the school and LA, as it is the LA who are ultimately responsible for ensuring provision EHCPs is provided. If necessary, you can force an appropriately qualified 1:1 to be provided via Judicial Review. However, if the EHCP is vague it can't be enforced, and you should focus on making it specific and quantified.

What the school are doing is illegally excluding DS. Remind the school part time timetables are illegal whether parents agree to them or not. They are only legal if short term working towards reintegration, that clearly doesn't apply if after 18months DS is still only attending 1 hour a day. Inform them he will be attending full time and you won't be picking him up early unless you have official exclusion paperwork. Again you can threaten Judicial Review if full time education isn't being provided, and depending on specifics may have a Disability Discrimination case.

Does DS' EHCP contain other provision such as SALT? If so, is he receiving it?

Lastly, do you think DS' EHCP meets his needs or do you think you need to ask for an early review or reassessment of needs?

Your son is of statutory school age and is entitled to full time education just like any other child.

They make many excuses as to why he can’t stop longer than a hour I also have a photo that I’m pretty concerned about but unsure if I’m just being over protective mom of my ds who is asd and none verbal is there anyway I can upload a photo on here to get advise ?

You can upload a photograph by clicking on the paperclip near where the text box is, but depending on what the photograph is of or if it is identifiable it may not be wise.

School can make all the excuses they want, but if you follow my pp they won't be able to continue to illegally exclude DS.

This photo was uploaded to the school website and I can clearly see his 1-1 with her legs ontop of him Holding him down. I don't know what reason she would have to do this or why ?

Hi, you've alot going on and had really good advice. With regards this photo on the school website yes, I would want some answers too. Please though, take a screenshot or save the picture before you address this with the school as it might 'disappear'. Put your concerns in writing.
Any occurances of 'restraint' been to be fully documented. You are entitled to see this paperwork.

Thankyou yes I have all photo saved. I have asked the school on a previous occasion when he had 4 finger scratches down his back how this happened. They said maybe it's from the zip on the pillows. He was wearing 2 layers of clothing ?? I asked was he restrained for any reason? They said no we have never had to do this.

I assume he does have an EHCP?

Write to the school reminding them that by law your child has a right to full time education plus all the support set out in section F of the EHCP, and copy it to the SEN department of the local authority. Ask them to provide their plan for increasing education hours starting next week, and ask for an early annual review meeting so that you can discuss exactly what they are doing to implement all the support in section F and whether any amendments are needed to facilitate full time attendance. Take someone with you to the meeting to take detailed notes and produce your own minutes afterwards recording everything that's been agreed.

If they continue ignoring you, write to the local authority and school threatening judicial review proceedings, and if that doesn't work contact SOS SEN to get a formal judicial review letter sent.

I'd also suggest you start looking at alternative schools. This one sounds pretty bad, to be honest, and I suspect that if they are made to have your child full time they will start looking for excuses to get rid of him anyway.
