Permanent exclusion

DS has just been permanently excluded from year 6 at primary school due to attacking staff and destroying a classroom. He has also just got a diagnosis for ADHD, and PDA if that's relevent. I think if I appealed the exclusion I'd have a chance of winning as school have not supported him well previous to this year, they've always maintained he doesn't have any SEN.

I don't want him going back to the school, I think the PRU will be able to support him better at the moment until he moves to year 7. I have no idea if year 7 will be mainstream or special school, it will in part depend on how the next few weeks go. He doesn't have an EHCP yet, school were saying they needed to get the evidence first, although they were already giving him 121.

What I want to know is if it is worth appealing the expulsion and what is the effect of him having it on his record?

Make a request for an EHCNA ASAP. IPSEA have a model letter on their website you can use. Even if you don't have to appeal it takes 20 weeks, and many people have to appeal at least once in the process, so you are pushing it for one to be in place for the start of Year 7. You are unlikely to get a SS place without one. Did you apply via the normal admissions round?

A single PX won't make a difference, it is when a pupil has been permanently excluded from more than one school issues can arise. Despite that I would still challenge the exclusion, even if you don't want him to attend again.

This sounds like disability discrimination - not necessarily just the exclusion (no doubt the school would argue they had a legitimate reason to exclude due to health and safety) but the prior lack of support. The school have failed to make reasonable adjustments. It would be a good idea to speak to IPSEA or SOSSEN about this.

Make sure the LA provide education from day 6.

No advice on a practical approach of appeal.
Mainstream doesn't sound good for him have you the option of a special school? Does he have a diagnosis? Why is the school disputing his disability?
They'd offer an SNA for behaviour they did with my DS pre diagnosis he is 6 now.
I hope you get it sorted.

I see he has a diagnosis sorry.
Poor kid mainstream is really stressful the school sound like a nightmare refusing help without paperwork.
