SEN child and detentions

My child is being diagnosed with ADHD and school have been unable to get the positive out of him for years, So now started secondary school September, first 2 days great then detentions, dd now has so many detentions that it will take him through to the otherside of the holidays, there mainly for talking, homework completed, class work completed just talks. Now isolation sent out of isolation for talking then excluded for a day due to challeging the teacher over talking and another day with isolation.

Does anyone else experince this, i'm worried they will permantly exclude him.

Has he got an EHCP? Is he on medication?

It sounds like he is really struggling with school, what support has been put in place so far?

I done an application myself and the school reluctantly helped, EHCP has been put on hold wanting more evidence, external agencies to get involved. We have been told by a specialist he has ADHD but waiting further assessments. So No to medication.
I work with special needs and it's normally me given advice but when it's your own It's different. I'm exhausted mentally so I recon my son must be.
I have emailed the school and told them to help me get an EHCP and help him. I know he doesn't mean to get in trouble, he wanted a phone so I said 7 days with no detention then you set a phone he did 2 days then got 2 detentions in one day.
I can't be the only one

As for support has a key worker who meets once a week and they pop in some lessons, I sort some help with the borough a transition team. They pop in every Friday.

I don’t think a child with ADHD can work towards a long term goal like a phone, they need short targets and quick rewards. I would hope the school has some ideas - maybe a report card for lessons and he can collect positive stamps/stickers? Then the stamps can count towards him getting a phone (rather than negative behaviour resetting it to zero).

It sounds like you need help with tackling the school and getting them to recognise his needs?

I'll have to reply later with some ideas as off to work now. I'm primary though and I do feel secondary is a bit of a different ball game sometimes. Getting the right people on board is the main thing.

What week are you on with the EHCP? Are the LA sticking to the timescales? The EHCNA is about gathering evidence so it shouldn't be delayed waiting for further evidence.

Have you had the exclusion paperwork? If the school have failed to make reasonable adjustments before excluding DS it may be disability discrimination. Try to speak to someone like IPSEA.

Do the school have a homework club? If not, or as well as, do the school put homework on a system you can access? If they don't you could ask the school to either email or write down DS' homework, so you are aware of what has been set. Perhaps starting with just completing core subject homework and gradually building up.

The school issuing so many detentions won't be helping. Even if he has brilliant days now, he still has days worth of detentions left. As Noble said, targets need to be short term.

Does DS have a time out card? Have the school considered where he is sat wthin next the classrooms? Some DC are best sat at the front, some at the back, some at the side, on a desk on their own...

I had a CAMHs meeting today and they're contacting the school to discuss what DC said to them. He also said things which they're now going to further assessments for having ASD.

His homework is fine, it seems to be talking is the problem and DC can talk. Due to Covid after school clubs and lunch clubs don't happen. DC is talented on a trampoline.

I agree regarding the goals but my husband is old school and really belives DC has control in what he does. It's nice to have an external view.

Regarding EHCP i was told it's put on hold to gather more information. Today I was told by the school the case was closed until further evidence has been gathered. I have stress to not give up on DC he is clever and they should get the correct help. They have agreed to help meanwhile I don't know what they will do about detentions they through policies at me. Do I have the right to say No to a build up of detentions.

They treat DC the same as everyone else but he atracts attention then he get silly comments or asked rehitorical questions by the teachers which causes the problems.

I've worked in special needs but i'm really struggling to focus on next steps, I've done all the refarrals myself so far. You loose sight when it's so close.

The LA &/or the school are leading you on a merry dance. Any necessary assessments should be carried out during the needs assessment. Have any assessments been carried out? Here are the timescales. Where did you get up to before the case was 'closed'? Do you have any paperwork from the LA? If the LA aren't going to assess or issue they should send you a letter informing you of your right of appeal.

The school should be making reasonable adjustments, failing to do so and then excluding due to behaviour arising from their needs not being met is disability discrimination.

Make sure you communicate in writing, you never know when you need the paper trail as evidence. Follow up any phone calls with emails.

Thank you yes I agree i'm lacking support from the school, I got a letter to appeal then when I emailed regarding the appeal i was informed it's waiting further evidence from external agencies that the school would need to request, then Covid happened and he was leaving so nothing happened.

The school said there going to seek support. lets wait and see

I am a bit confused here. Who actually applied for the EHC Needs Assessment - you or the school? Or do you mean the school is waiting for more info before they make the application?

Sorry I applied myself at primary school around October the school said there's worst children than DC but they called me everyday, running out of class, kicking doors or hiding no playtime and didn't think there was a need then lockdown happened, during lockdown they refused to let dc attend due to being high risk. Now DC has gone to secondary school so I asked for help due to getting detentions every night. There was help from Early help transition team but he secondary school thought he would be fine and didn't believe what was said.

Since I questioned it on here I emailed the school and said you need to get expert advice to support an EHCP. I was frightened they will permanently exclude him without trying. This is when the secondary school said it wasn't put on hold. It said something about waiting for progression.

So you applied in October last year? Did you get a response from the LA?

Yes March 2020 Insufficient evidence, when I called regarding appealing they said it's okay but the school need to get behaviour team in to gain more evidence. Then I can continue the application.
I did find out from CAMHs the school thought there was nothing wrong with with DC just naughty in school no needs just behaviour, I know that's not true.
I think I need to start again and the new school agree there's a need.

Did you submit an appeal to SENDIST? Or was it the LA you emailed/called?

Assessments that form part of the needs assessment are organised by the LA.

It might be worthwhile speaking to IPSEA or SOSSEN.

It was the LA, and due to lockdown I was stuck for help. I'm going to get support this time, CAMHS have been in touch with the school already.
