Specialist Provision Post 16

My son has been located specialist provision at post sixteen. He has 15 hours a week at this provider (an additional two days at another provider). Initially the 15 hours were to include breaks and lunchtimes (against gov guidelines). We are contesting this and so far the college have agreed to an additional 30mins a day for break/lunch. We don't think this is enough - wondered what other people think?

Does he have an EHCP?

Yes he has a EHCP - he has Prader Will Syndrome and Autism. The LA has commissioned the provision. The provision are dragging their feet to give him more than 30mins break and lunch (because it is not in the funded hours - shouldn't be in the hours). Anyway we have got them to move from 0mins to 30mins so will keep trying.

The provision should be written into the EHCP and then the LA are responsible for funding it properly. When was the last annual review?

And why is he having 15 hours in one place and two days somewhere else? What happens on the 5th day?

The provision is written into the EHCP - it is a detailed, specific plan. The Local Authority have commissioned the provision and it is properly funded. It is not the job of the local authority to fund lunch or breaks . With regard to providers - this is how our authority works - 3 days with the main provider and two days additionality. We have no complaint with the authority - unhappy with the provider who want to include lunch within the funded hours for education.
