Dissability for boy aged two

Hi all we applied for dissability for our baby boy who is aged two,,he has narrowing off the airways which is called subglottic stenosis from when he was born,hi suffers daily with his breathing has had seizures been admitted to hospital loads,always on steroids,vomits a lot ,we was refused dissbility for him ,was wondering does anyone know if this is a dissability in a child pls or gets for their child with similar problems,,thanks

Do you mean you applied for and were refused DLA?

If so, DLA isn't based on a diagnosis (though your DS meets the Equality Act's definition if having a disability) but on needs - you don't need a diagnosis to receive DLA. You need to show DS needs a higher level of care than a child of the same age. As all 2 year olds need a lot of care the bar is higher than if your DS was 12. Some people don't get it when their DC are younger but are successful when they are older.

You also can't get the mobility part until 3 years old for high rate and 5 years old for low rate.

I would suggest you ask for a mandatory reconsideration as lots are turned down initially, and look at the Cerebra guide.

You have to show what care your child needs over and above a child of a similar age and as a pp said any two year old would need a high level of care, you also need supporting evidence from people involved in your sons, care ,paediatrician ,health visitor etc a diagnosis isn't essential ( although it might help) as it goes off need did you have any help filling out the form ? As it's often the way questions are answered that trigger an award .
