Court hearing ABA in Mainstream School: which witness to take with me?

Hello all

Now i am very stressed out and worried...as I Just received a letter from the court.

The court hearing is in the first week of January 2020.

I really need to hear from your experiencr...how did u convince the judge...how did that meeting ho...who were the 3 witnesses you took to the court?

I need your advice plz.

Not sure about EP as still dont have one...my lawyer through legal aide is looking for funding.

Is the attendence of the lawyer important in the hearing?

The problem is i have to pay her more than 600£ to be a witness which i cannot afgord as I am low income...

I will have to.pay for the ABA reports and the ABA supervisor and attendebce to to heating which will.cost me loads :(

Who else will be most important as a witness to the court?

Let me know please.

Myself as his mother and tutor with my ABA supervisor must submit evidence by november.

Not sure if the progress with the self help can convince the judge...
The LA are pushing towards a special school...
I have another autistic child: my daughter who will be 6 in February and she is in year 1 in Mainstream.school.and started talking and doing relatively better than.my son.

I do ABA for her too... so it is a huge load on.me as a mum :(
Lots of hard work...

We just started using PECS as my son is still.non.verbal :(

Can you plz advise me what should i.prepare exactly for the hearing?

Which witnesses are most helpful apart from.EP...ABA prodessionals...

What things should I not miss to bring intk my discussion?

How could i convince the judge that special school is detrimental to my sons future and progress... by the way i have 2 other healthy neuro.typical.kids who (although they are younger) are helping with my autistic two kids...
So mainstream should help my autistic kids....

Plz advise me...i am so stressed and worried

By "a political decision", I mean that it is politicians who decided that legal aid should not be available for tribunal hearings.

Schools have no money. Maybe one of these ABA tutors may be the best possible option for your son, but when TAs that enable my dyslexic dc to access the curriculum more thoroughly are being taken from classes due to budget cuts, then I'm not sure of the justification for such an expensive bespoke package for the benefit of one child!

How on earth would a SEN child cope in.a class without TA?

Are you.sure budget cut will.involve evenذ TA??

The vast majority of SEN pupils have no 1 to 1 TA. My dd struggles immensely in mainstream. From the outside she is "higher functioning" ASD, she is verbal, seems "fine". But she isn't and struggles immensely with the noise, busyness and social side of mainstream school. It causes her immense anxiety, meaning she often school refuses as the anxiety cripples her. We are only just starting the EHCP process.

SEND has been massively underfunded for years now and as the budget cuts hit, the extra staff like TAs are the first to go.

Because mainstream classes tend to only have children with a certain level of SEN, inclusion is only meaningful up to a point. If a child's needs were that great that a specialist tutor is needed then are they best fitted to mainstream education? What would the benefit to the child be? Would they be able to access the curriculum (even with 1:1 support)? Would they be able to make friends?

There's a girl in my dd's class who has severe behaviour, mobility and communication difficulties (I think she is autistic but not sure) she gets to choose a 'friend' each playtime to go out with her and her TA, the girls all go because they are told to but they hate it, they're scared of her as she has hurt them many times when she has a meltdown.

Your daughter sounds similar to a boy who my ds went to primary school with. He did have some difficulties (often with noise and over stimulation) and his TA support helped him with this. He did really well academically and socially, he's ace and the rest of his class learnt a lot about empathy, they all still keep in touch although they have gone their separate ways after year 11.

If provision for ABA is put into the EHCP, school budget cuts are irrelevant because the local authority has a statutory duty to ensure that it is delivered, including by giving the necessary funding to the school.

DocFartin, if your child needs a TA and isn't getting this, that would be very good evidence of the need for an EHC Plan and, similarly, your child would then have a statutory right to the support in question.

My daughter isn't going to get an EHCP for dyslexia 🤣 there's a TA across all the year group (3 form entry) and she does some bits with her once or twice a week. She'll have extra time in her SATS next year, but that's it!!

EHCPs are like hens teeth!

Ur daughter seems similar to mine...in which year is she?
Mine is jn year 1... i was told that they improve much after year 2

Other says...the gap between thrm and their peers gets larger Sad

Why dont u apply for EHCP...

they refused assessing my daughter last march but i appeal...then accepted 1 day before court hearing...now she is being assessed... hopefully she will get EHCP...fingers crossed

My daughter has moderate dyslexia, no other issues, she categorically won't get an EHCP for that.

That's not the point of my comments though.
