Can I challenge my daughters DLA award if I think its wrong? Currently midrate care low rate mobility. Shes been getting it about a year. Can I appeal it or is it too late?

Yes you can. But they can also reduce or stop it, so make sure you have expert advice

You are usually given a time frame to appeal when you are notified of their decision.

How long was she awarded that rate of DLA for?

If her circumstances have changed (which you should notify them about anyway) and you think she needs a higher award because of that, you can ask.

It may be worthwhile waiting to gather more reports and evidence to back up your claim for a higher award before approaching DWP.

I would have a read of the cerebra dla guide (google it if you haven’t seen it before) and you can find out how they award the different rates and whether you should be getting a different rate according to that (high rate care is mostly about night time care needs for example, even if there is more care during the day than you previously had on mid rate you would still get mid rate unless there were substantial night time care needs).

If you feel you definitely do meet the criteria then definitely contact them. They will reassess the whole award.

An appeal changes the decision as originally made. It's too late to appeal unless there are very good reasons why you did not appeal when the award was made. You can ask for the award to be looked at again at any stage, in which case it may be superseded (a different award made from a date later than the original decision). If you ask them to do this be very careful: they can reduce the award.
