hi my son aged 4 has asd he gets middle rate care componant of dla i was just wondering if any body knows what the reasons for claiming the mobility part are...
he can walk but has to be supervised at all times (held on to more like) or in his push chair he has no sense of danger at all and very little understanding of what we are saying to him he is non verbal too..

thankyou

my son sounds EXACTLY like your son, even the same age
We get the higher rate of care and the higher rate of mobility.
I called my local advice line (DIAC) and they sent me a copy of the disability handbook guidelines for the criteria on claiming mobility and we claimed using the mental impairment criteria.
We also included a report from his school teacher (SLD) explaing his capabilities and understanding etc and our paed said we could include her name as a reference tho im not sure if the wrote to her.

HTH goodluck

Does he have ASD? Even if not, you might find the info at the NAS website useful www.nas.org.uk They have lots of downloadable info sheets and getting DLA inc mobility is one of them.

thanks davros i will take a look at that now and yes he has asd

you can put in a claim at any time, thou if you ask about the mobility bit then they often say they will have to do the care again, i think they say it to put us off, they usually tell you that when they review the care rate it may go down, again i think that is said to put you off.

bubble78 · 27/04/2007 10:06

oh i dont know whether to bother then i dont want it going down he needs as much care as he did when i filled it in the first time ( still in nappies still needs feeding still cant communicate etc)

oh i dont know what to do now will go have a think

They said that to me too.
We had been claiming middle rate with no mobility for 6 mths and our paed said we should ask them to look again and get higher rate and mobility, they turned us down for the mobility but gave us the higher rate care. This is when I called DIAC, then I called DLA and told them that I wanted them to look again because I felt he filled the criteria I mentioned before, they asked me to get the report, they said they would look again at both and I heard back a few months later.(and in fact they said that I need'nt send the report when I rang them to query something but I chose to anyway)

onlyjoking9329 · 27/04/2007 12:47

don't let them put you off (that is their intension)go for it and don't take any notice of the comments they make they are counting on you just leaving it.

bubble78 · 27/04/2007 13:23

the thing is he has been recieveing it at middle rate care only since just before he turned 3 he was 4 in january this year so i think its to late anyway isnt i just read somewhere an award cant be changed if its more than 13 months since it was awarded???

i think his is up for renewal in january when he turns 5 so may just wait till then???

Please don't be put off

I know the forms are horrible but it sounds like although his needs haven't changed, he is receiving more care than the average 4 year old and that is what they will look

To get high rate care, you need to be doing personal care things day and night. Does he wake in the night? What do you have to do if he does ie nappy change, sit with til falls asleep or can he be left alone or not. All these things add up to high rate (personal care = toileting, breathing, eating and medication)

Also, the mobility bit, can he walk along the street safely like an avareage four year old? Does he use a buggy? You are more than likely eligable for high rate there too

I'm sure they make it hard so less people claim but i'd persevere if I was you, it can make that little bit of difference having that bit extra

Good luck

bubble78 · 27/04/2007 14:22

thanks big bird yes he wakes in night nearly every night usually if his nappy is too wet and then i change it then sometimes he does not go back to sleep so we have to get up and come down stairs with him. and no he couldnt walk without being held on to he would just run in front of cars or he gets upset and stands with his hands on his ears if a loud car or bike or a bus or lorry goes past. and do you think i should ring to change claim now i have just looked through all the paper work he was awarded middle rate in feb 17th 2006 till 12 march 2008

i just worried about calling if i am meant to wait till renewal or if it can be done now. (i know im just soft really)
