EHC assessment denied

First time posting so not sure quite how it works.
DS is in year 10, diagnosed ADHD 9 months ago and waiting for ASD assessments to finish. He has had challenging behaviour since entering senior school mostly around aggressive outbursts and attacking other students. This has lead to 7 exclusions in the past 2 years, 4 of those this year and 3 police visits for assault. I applied for an EHC assessment 6 weeks ago as he didn't seem to be getting much support from school other than exclusions and removal from school when he kicked off. I spend the previous term picking him up at break and lunchtimes as he wasn't allowed on school site. I spent the entire time trying to get him back into school because he refused to go back. This term he is being kept isolated from other students for break and lunchtimes in school, although not always supervised. He has been assessed by an Ed Psych who believes he has ASD and high anxiety. We have been waiting for nearly 15 months for his social and communications assessment for ASD. We have just been informed that he will not be assessed for an EHCP as he working at GCSE level 3 for English, 4 for maths and 5 for science so is not apparently behind even though his expected grades are high levels 6 and 7. He hasn't been able to do last terms assessments because he has missed most of the content due to exclusions.They also said that the school had not proven that they had used all the resources available to them and he get all the help he needs that way. It would appear that physical attacks on other students and verbal attacks on staff are not a priority. Would it be worth appealing?

We were turned down initially because my child is not significantly behind academically but just the threat of an appeal (I got our OT to 'have a word' and wrote a letter detailing why we were appealing) and they changed their minds. From things I've read here, lots of people get refusal to assess and then win on appeal. Feels a bit like a horrible game. Good luck! X

Appeal, always appeal a no decision, the LA's use it as a way to filter people out. One yr my LA refused to assess every single parental request! Dont give up.

Yes appeal. Use IPSea refusal to assess pack.

The threshold for assessment is "has not may have Sen and may need an EHCP".
