I requested an assessment for EHCP for DS, the 6 weeks is up tomorrow.
How likely is it I'll actually get an answer tomorrow? I'm so so nervous. Going to try and keep busy so I'm not constantly checking my emails.

Hi this was me last week. My LA refused I knew they would tbh but it still hit me hard! I'm much better this week as had already planned private assessments in advance and have my last one tomorrow. So I feel much much better as the more professionals I speak to I can see I have a good case to fight.. I remember when I had the refusal to assess letter in my hand my heart was beating so fast worse than any exam results I have ever awaited! Even more than my stressful wait for my MA results! Just goes to show how precious our kids are to us, good luck Flowers

The senco has said they don't think school can meet his needs so I have a glimmer of hope but don't want to get my hopes up iykwim?

Also don't know if they'll ring, write or email.

Yep tomorrow is Friday. So you'll hear at close of play or not at all.

If you don't hear then email first thing Monday very simply stating that they have a statutory duty to inform you within 6 weeks and if you haven't had any communication by end of that day you'll start judicial review.

Just showing you know what your talking about usually is enough to kick them into action.

And yes many will refuse whatever is actually going on. My ds application was refused, he ended up too anxious to attend school and still they forced it to tribunal - they were ordered to assess and awarded 20 hours a week - using the same assessments already done Hmm

Don't get tangled up in negotiations and long conversations. Simply keep your eye on the prize and remind them of their statutory duty to award it

He's not attended school this term due to anxiety. Can't believe it's been able to get this bad tbh.

Will email Monday if I don't hear tomorrow, thank you. I struggle as I try so hard to be polite and very British in not making a fuss so need to get a bit more badass.

I had that issue too.

I'm quite badass now but still polite.

I've just learnt to be very factual and to the point!

I had to chase as I hadn't heard and yes they refused (as seems to be standard) immediately told them I would be challenging. They then miraculously "reviewed my application" ( I doubt they'd read it in the first place.) this was four years ago and now he's in a special school, so totally mad they play this game of rejecting. It seems to be standard practice in some counties to buy them more time and to test the parents resolve.

wevecomeonholidaybymistake, don't be British and polite! You're not being badass anyway. Your child has a legal entitlement to an education and that's not asking for much. You don't have to wait for SEN to contact you, you can always call them for an update if you're feeling up to it, or ask IASS to call on your behalf. Showing that you're proactive is a good thing. Fingers crossed for you.
