Looking for refusal to assess stats

Hi

I seem to remember that someone had done a FOI request to LAs and collated the results which showed a huge disparity between LAs and their treatment of requests for assessment. I think Warrington carried out assessment in response to almost all requests whereas Southampton refused to access in response to nearly all requests. Have I imagined this or does anyone else remember this and can provide a link? I can't find anything. TIA

I still 'see' bjk around on a closed fb site. She is still fighting the good fight Smile

I've had a quiet spell but am just bracing myself for the next round with EHCP transfer.

Interesting reading!!!

"They will say there was no evidence provided by the school, or the wrong sort of evidence was provided, when it is down to them to get that evidence - they hope they won't be challenged," she said.

This was what happens to us. They said the school hadn't provided enough evidence so refused. Thankfully the head was great and said that the reason she couldn't submit the work samples is because he's non productive hence the application!! are they actually asking her to deliberately distress an already struggling child by forcing him to get zero marks in a test? Immediate back down once the school was on to it so I do agree also that even as the stereotypical middle class parent with a decent skill set there is still no way I could have done it alone. Ironically he was awarded a high level package at a special school so does make me wonder what the hell might have happened to him without the war of words. And it continues.... the fight to actually get the provision even when it's in the plan is just as bad Sad Angry

How ironic. We were turned down because school apparently didn't provide enough evidence to the LA. I attached the school's application form and support plans for 2 years that the school provided with its applications to my appeal to prove that evidence had been submitted.

Frustrating in some ways is that dd manages academically, but is a girl with ASD and a great marker. While she is clearly coping less well at school, home is an entirely different matter. However we are looking for a regular contact person, not a full time 1 to 1, especially for social issues.

We were turned down as "the school could meet his needs through it's own resources". If meeting his needs meant him just about scraping along at the bottom of the class with no real friends and a significant deficit in every day skills such as the use of scissors then yes, they were met. I wasn't going to settle for that and fought, but I suspect many families would not have known how to appeal successfully, or had the resources to do so.

Snap whoknows! That was our second point of refusal. Word for word. Do the LAs collude or what?!?!

youarenotkiddingme · 15/05/2017 19:32

Yep. All I kept being told was "school can meet need with resources available to them"

I ignored this as ds had been out of school for a few months and then started a new placement on Mm. The move failed after trial and it was extended.

I was clever enough to ignore all the "we can" "we've done x y and z" and allow the lies information to be given in tribunal.

I simply said at the end "it's clear the resources available aren't enough for ds or he'd have a named school place"

youarenotkiddingme · 15/05/2017 19:36

I'm in the county that 2 of the places mentioned are in but educationally are separate from.

When I speak to sodden or IPSea and they ask me the county - they always sigh at the answer!

imip · 15/05/2017 19:37

Yes, I highlighted school's expenditure from the original ehcp (over that £6,000 mythical figure) and told them that we wanted to protect that amount due to upcoming funding cuts.

I must say the whole idea of actually going into a tribunal freaks me out....

youarenotkiddingme · 15/05/2017 21:31

The 6k thing is a red herring. Schools must provide the first 6k where support exceeds that.

But an EHCP is for when needs can't be met within the resources usually available .

Those resources could be 1:1 support above 12 hours or sensory therapy that isn't usually available.

I'm there too Youare, the county not those cities. I did get through without having to actually go to tribunal though, the LA conceded both my appeals.

youarenotkiddingme · 16/05/2017 18:28

Oh who I'd be interested to know what part! I'm in F and G.

EH. I used to live in your part, pre-DCs.
