EHCP mediation

Dd has had her ehcp approved however I don't agree with the named setting or that she can only access English, maths and science

I've spoken to a mediator who says that usually he deals with refusal to assess appeals so this is fairly new territory for him

Is it worth going to mediation? I believe that because i'm appealing the named provision (which is mainstream with remote tutors provided through the medical needs provision) that I can go straight to appeal

Has anyone found mediation helpful?

Hi Emo - this board doesn't get a huge amount of traffic - try re-posting on SN chat or SN children as these get visited most often (although both might be more quiet over Xmas too).

I don't have any experience in mediation to advise I'm afraid (although my instinct would be to agree go straight to Tribunal and contact SOSSEN or Ipsea asap for advice. But I know there are posters on the other SN boards who have challenged the LA's preferred placements when they feel they can't meet their DC's needs.Good luck)

I believe the requirement is to "consider mediation". You don't actually have to go to mediation. You will need a certificate to say you have considered it though before you can go to Tribunal.

We appealed to the Tribunal twice but didn't go to mediation because we knew our LA were useless at communication and the solicitor advised us not to as mediation can take ages to arrange and would delay getting a Tribunal date.
Our son was out of education for a year. it would have been even longer if we had faffed around with mediation.
