DLA - Mandatory Reconsideration, has anyone done this?

Did DS DLA renewal a couple of weeks ago, the awards letter arrived yesterday, he was previously on high rate care with no mobility (as he was under 5 when i applied). He's been awarded middle rate care and low mobility, i dont understand why they haven't awarded High care again as DS is up and ready to go between 4 and 5am!! EVERYDAY Sad. Im going to call them tomorrow and ask them to clarify what night care actually is, in my opinion its hardly "normal" for a child of 6 (7 in feb) to wake to blooming early or is it? Hmm.

Has anyone ask for their claim to be looked at again? how long did it take?

I dont have any additional evidence to send them as i have sent them literally everything!

Your thoughts please.

I think they count night time as the time when the family is usually asleep. not sure how much night time care you have to provide though (in hours)

Thank c4akedout I would almost certainly be asleep given a choice Grin

Just done a little googleing and it would appear that like you say its the hours that you would expect your household to be shut down/asleep.....maybe they think we're nocturnal Wink

I had a mandetory reconsideration and it only took a few weeks to hear.

I know a few of DS peers wake around 5am so I am not sure it would be considered out of the ordinary enough to get HRC but it is worth trying!

Ds2 can get up any time from 3, yet still only got MRC.

I never bothered appealing, but good luck if you do.

I wrote asking for a mandatory reconsideration based on night time issues and got an answer within 2 weeks. We were given high rate care as DS is regularly up until 3am.

OP, google DLA and 'decision makers guide'. will bring up the DMG. it referred as night time care to the hours the household would usually be asleep. suppose if you have to get up at 4 or 5 each day and this is considerably earlier than the rest of the household then you should qualify.

lemony - if your DC is regularly up that early I would run this via the dwp. if appeal has passed then under a change of circumstances or whatever this is called.

Dc was refused DLA both when we applied and asked for a reconsideration but was awarded high rate care on appeal. she has ASD and severe LD and we are up a few hours every night. it is one thing what you get awarded but another what you should get and often they rely on parents appealing to make the correct award.
