I don't have my statement - its overdue - tribunal order breeched

Its taken two appeals and 17 months of my life to get here = no where

My schools head said my sons are a 'significant additional cost to his school'

I had my LA rep leave over 1200 pages of my sons LA and NHS file in a public building

I have been called a liar and a bad parent

I have at all times been treated with utter contempt

My child is seven, has never had any qualified SLT at school but has a 3.5 year speech delay.

That's just the half of it

I'm pissed off to the core, in fact there isn't one once of me that isn't

7.—(1) An irregularity resulting from a failure to comply with any requirement in these Rules, a practice direction or a direction, does not of itself render void the proceedings or any step taken in the proceedings.
(2) If a party has failed to comply with a requirement in these Rules, a practice direction or a direction, the Tribunal may take such action as it considers just, which may include—
(a) waiving the requirement;
(b) requiring the failure to be remedied;
(c) exercising its power under rule 8 (striking out a party’s case);
(d) exercising its power under paragraph (3); or
(e) except in mental health cases, restricting a party’s participation in the proceedings.

Hang on and I'll look over your previous threads and try and work out where you are - I think you are the one with the 'holding statement' and an EHCP but I have a rubbish memory

No - you are just straight statement I think, although I am not great at tracing the thing back.

So forget the thing above if you don't have on-going proceedings.

So I suggest.
-check with the Tribunal just in case they have it and get it from them if they do

  • Write straight to the head of the LA legal dept and say that they are in breach of a Tribunal and you are consulting solicitors about enforcing it via judicial review.
  • And stuff the LGO and go straight to Maxwell Gillott to get legal aid for dc to enforce the Tribunal Order 17 months of dc's education is a lot. MG should be able to write a letter before action which will put the wind up LA-legal as their budget will be hit by the sen depts incompetence which won't go down well.

If you do have on-going proceedings then ask for an order under section 7 quoted above "that the LA's case in these proceedings will be struck out unless they comply with the [earlier order] by [insert date not far away]"

Here's a letter to the head of legal for you. I don't mind if you use it or not, it is really just because I want to do something to help...

[Local Authority - we'll call it Scroogeshire for now]
[address]

Dear Womble
[Appeal Number, mini-2Boys]

I attach an Order of the SEN Tribunal dated [insert] which requires Scroogeshire LA to produce a final signed Statement of SEN withing 5 weeks of the date of the order.

That deadline expired yesterday.

Please could you arrange for the SEN department to forward it to me by email immediately?

I am contacting legal aid solicitors to start the process of obtaining legal aid in mini-2boy's name, but obviously it would be preferable for Scroogeshire LA, mini-2boys and me if that, and any subsequent Judicial Review, proved unnecessary.

Please acknowledge receipt of this email by return"
