I think my statement is overdue?! When can I complain to LGO?

I was told on the 4th feb statement had to be issued in five weeks. Is that today? I thought it was tomorrow but dh says it's today?!

hmmm can see it both ways - I would give it until the end of tomorrow then there is absolutely no uncertainty

It is usually counted from the day after I'm afraid. I can't find the rule that says so, though.

They missed their deadline for serving the nil so I might not even get it tomorrow. Why does everything have to be left till last minute?

If it is late can I go straight to LGO - or do I need to complain to them first?

Less than two hours to go.

Had a meeting at school this morning and them rather than build a bridge they have declared war. My son is not a victim and neither am I, I'm going no where and they better face that.

Then I saw my health Vistor who told me I just have to deal with the possibility of three sen kids as she knows another mum of five who has three physically disabled kids.

I say no I don't actually. I can fight for a better life. I can say up yours to this crap. And I am.

do you think they will send it via email? I got mine through the post as because it is a statement they have to send you the original appendices as well not the copies

Everything normally comes via email. Mines a statement too.

My case officer said yesterday it's the tribunal clarks responsibility. No one it seems want to be responsible for taking ownership. That came out in the appeal. No one knew who wrote the naff nil.

Suffering Christ and his gout-ridden disciples, is there no limit to the shit these people spout whilst on the taxpayer's shilling?

Once Tribunal has made a decision - in this case, that your DC must be statemented - the only responsibility the tribunal clerk has is to send this decision to you and your LA.

If you were contesting the contents of an already-written statement, then the LA must include the changes to the statement that Tribunal has directed in their decision notice. That decision notice is sent out by a clerk, but is written by a judge.

Tribunal clerks aren't trained to write statements. Tribunal clerks don't have the legal authority to write statements. The only people who are responsible for producing the statement are the local authority. As well they fucking know.

And if your case officer genuinely does not know this, then they really, really need to find a new job. Perhaps one where they can be more socially useful, whilst putting their recent co-production training to good use. Tossing off pigs on the farm for money springs to mind.

When they refer to the tribunal clerk, do they mean the council's own tribunal officer?

Not that it matters, it's not your concern whose responsibility it is, the point is that you're supposed to get the statement. I would suggest you contact the Head of Education directly and tell them that unless you receive the statement immediately you will be taking judicial review action through the courts.

How do you go about getting a jr? I have told sendist I didn't get it and directed it to my judge who ordered it.

Got a meeting on Friday where it's all to my benefit that my la keeps f-ing up.

Might email ed Timpson tomorrow and cc the sen bod from the la.

I am thinking of as many ways I can to ensure karma ensues Grin

you need a solicitor for a JR as they have to do a letter then if it goes to a full JR it goes in childs name to get legal aid. my friend last week was looking at having to do it and I have the numbers of sen solicitors who she was recommended so if you need them let me know
