Draft EHCP. No mention of 1:1

DD's draft EHCP has finally been sent to me but I cannot find any mention of a1:1 support anywhere in the report. DD has complex medical needs and requires 24 hour waking care. I'm very confused and concerned. What part of the EHCP should cover this?

It should be in section F.

The Code states that provision must be detailed and specific and should normally be quantified, for example in terms of the type, hours and frequency of support and levels of expertise. It also states that provision must be specified for each and every need specified in section B.
This is not just guidance; it reflects the law as developed through case law in relation to statements and the corresponding provision in the Education Act 1996 which had the same wording.

So if it isn't quantified and specified then you need to ask the LA to amend so that it is. If they refuse then you will have to appeal. It's all under section 9.69 of the new code if you want to have a proper look at what should be there.

If a child had eg a need for oxygen or nasal tube feeding, I would expect it to be either medical, or just possibly social.

If a child needed to LEARN how to do the oxygen or nasal tube feeding, that would be educational.

I have just had to spend a chunk of yesterday trying to get my head round W -v- Leeds which includes the concept that the child should be treated 'holistically' with all the services sharing the cost. If only...

There is always the option of getting direct payments - you may already know that social services is very familiar with this - and recruit someone (or 2 people can be easier for holiday/sickness cover of each other) . These people could be trained up by you and be much more effective than an LA employee, and you will have more confidence in them..

Just to say thanks for all the replies, the 1:1 provision has been added for her medical needs.... Now just to find a school.....

Just to make it clear - it doesn't necessarily have to be something that your child needs to learn how to do to make it an educational need. It is still educational if it means they won't be able to access education without the relevant support. For instance, children have had provision in statements to deal with things like diabetes, because if their blood sugar levels go wrong they won't be able to concentrate and the situation could rapidly become dangerous - if they're hauled off to hospital for lack of adequate care in school that will certainly affect their education. Equally,
something like ensuring an adequate oxygen supply certainly comes within that category, as would nasal tube feeding as I assume care would be needed to ensure the tube doesn't get blocked or dislodged.
