bjk if it is otherwise copied pretty much word for word, you have hin by the proverbials.

Remember Judge Judy always gets then to admit how honest and straightforward they are, and how they take care in a case involving a child, and how they would be happy to give their evidence on oath#

And then she shafts them with the truth.

bjk you're probably already there right now, just wanted to let you know I have everything crossed for you and really hope you can post a positive outcome later!

I'm more of a lurker but have been following your story with great interest and horror at how you've been treated by the LA! Can't help but wonder, is this normal treatment for those trying to secure lawful supportive provision for their DCs or is your LA particularly twisted difficult?

bedelia I hear there are very few tribunals in Northampton. Birmingham used to be utter swines but they reformed. Not sure how it is going there now.

There are a lot some repeat offenders in the South East...

What worries me is the huge number of kids with parents who have not heard of SENDIST and think that the LA experts are genuinely sorting out what their kids need.

So conclude that either their kids are 'bad' or that they are 'bad' parents...

senvet parents who don't know the system worry me too. Our LA seems to have persuaded not only parents but loads of professionals (education and health) that the ECHPs are only for dcs who need a special school place. I hope that if we win on Thursday the LA may be directed to think again.

^This is exactly why I'm doing my research now senvet! I don't know if SENDIST was around 10-12 years ago (nor did I have access to the net) when my eldest was refused a statement by our LA... In hindsight, he really really needed it, and I wish I'd felt that I could have fought for better provision/recognition of his needs. At least I'm better informed now, so trying to learn whether or not he can get some support.

It all fell into place when concerns were raised about my youngest DS (who I think has similar, possibly more severe issues). I'm going to make darn sure I follow my instincts this time and make sure he does get the education he deserves!

NoHaudin best of luck for Thursday! Will keep my fingers crossed for you too in the hope that your LA will reconsider their stance on lawful provision!

Me too. I was at a meeting last week, govt research about how LAs spend SEN money, looking at improvements Hmm and I was shocked at the number of parents who had blindly let their LAs make all sorts of arrangements for their children, with very little discussion or consultation, and a lot of lying about parents' and LA's rights and responsibilities. So many children in completely wrong placements, because they had been fed false information about suitability and hadn't known they could challenge it. And what was MOST worrying, was that these were all parents who are heavily involved in advising other parents of their rights and responsibilities Shock.

I was looking through the SEN section in our LAs latest education guide and I noticed all reference to being able to appeal to tribunal have been dropped since the last version. It looks like mediation is your final option now! But in Scotland you have to get a CSP to get legal protection and these are harder to get than a statement/EHCP as you must have significant involvement from an agency other than education. When they were being put in place the LAs argued that something like 20% of kids would get one and there would be overwhelming demand on services; the reality has been iirc 0.2% have got one.

Bilberry I just checked my LA's Local Offer website and after a lot of digging to even find reference to appeal/tribunal have found suggestion that Tribunal is only available where they refuse to assess/draw up an EHCP/amend after AR or drop the plan. Apparently if you don't agree with the contents of an EHCP you only have the choice for mediation Confused Surely that's misleading...

Yes, they don't exactly fall over themselves to let you know what you are entitled to. I remember my HT looking horrified when I mentioned something I was entitled to and asked how I found out!
