senvet, I absolutely know that in law needs have to be met - my reference to funding related to the reason it isn't happening, as opposed to excusing it. Hence the suggestion in my first post that Timpson be made aware that he can change the law till he's blue in the face, it doesn't help children unless he does something about making LAs obey the law.

bjk, I second the suggestion that it be a requirement EPs and other experts be instructed that they must give recommendations for specific and detailed support. LAs always hide behind the defence that they can't put support in unless it is evidenced in the reports, but their duty to specify and detail provision is absolutely clear and therefore it is up to them to ensure that they get the advice they need in order to comply with that.

In an ideal world the assessment process would be taken out of the hands of the LA and dealt with by independent experts, but sadly I can't see that happening any time soon.

ici sorry I was in full flood rant, but I just don't get why LAs don't just draw attention to the pathetically inadequate amount they have to try to meet their legal obligations for SEN by actually costing them, and then presenting a plan to the Government so there can be a proper debate in the press etc.

It seems to be raised on a case by case basis, and there is no real inkling as too how very, very wide of the mark they are.

The various SEN laws/regulations all state that provision has to be 100% needs based. Yet it can never be when there's LAs budgets. It is a ridiculous situation. A LA will NEVER be able to meet their legal obligations because the needs argument is a blank chequebook.

Don't get me wrong, I have no sympathy whatsoever for the LAs. They need to tell the government that they can't meet their obligations and stop all the empire building they've individually done and get a proper job and stop playing with our children's lives
