After mondays meeting where the LEA say they are not accepting DS dx from our private psych i started thinking.

So, yesterday i phoned PP and told them what had gone on and told them that i was aware that what they had said re our psych was illegal and that i had had enough and was considering taking legal action as they have done nothing but mess us around for a year, she said she would phone the LEA immediately.

An hour later the PP lady phoned and said she had spoken to the lady and that the lady said "when i got back to the office on Monday, i did some checking around and i have since discovered that mr XXXXXXX is a very highly regarded professional and we will accept his dx, and that jenk1 has completely taken my worlds out of concept because i never implied that a statement wouldnt be written without an nhs dx"
She is a barefaced liar and both me and DH and the psych heard her say that she wouldnt be writing a statement without an NHS dx, PP tried to smoothe things over by saying that the LEA lady "hadnt realised" so i said that if the LEA dont realise who are supposed to know SEN law inside out what hope is there for the rest of us?

I also told the PP lady that should the LEA turn DS down for a statement that we would go straight back to SENDIST, and she said "i dont think they will turn him down as they realise that you will take this all the way to tribunal, thats the vibes im picking up"

Our psych has told us that he doubts DS will make it back into the new school full time and that we are looking at a special school for him, he said that will have to go to tribunal but that he is 100% certain that we will win as the LEA have shot themselves in the foot too many times.

And now nursery are making assessment noises about DD so we will have to go through all this again, i havent told the LEA lady that we have a DD with SN, ill save that for when DS is sorted out.

Phew.......... you will need a cup of tea after reading all this!!!!!

Arrrgghhhh! what a pack of liars! it makes me soo cross, that they get away with it. The awful thing is that there are many, many parents who just accept what they say and don't take things any further.

We came across similar games with our previous LEA (one of the worst for this type of thing in the country).

What I don't understand is why isnt someone keeping an eye on this sort of thing. Where I live now (Brighton) the LEA is pretty excellent, we have had no problems. Full ABA funding for 2 yrs and a placement in an excellent ASD unit now. We are so lucky that we live in a progressive LEA. Some people get bugger all without a fight.

I hope you get what both ds and dd need. x

It was from the Special Educational Needs Code of practice. the DFES ref if you dont have it for ordering the book is DFES/581/2001.

Chapter 5 Identification,assessment and provision in the primary phase, its on page 49 about half way down:

Working with other providers of support

5:27 Many children with special educational needs have a range of difficulties and the achievement of educational objectives is likely to be delayed without partnership in the childres education between all concerned. Thus support for children with special educational needs requires a concerted approach from healthcare professionals,social services departments,specialist LEA support serices and other providers of support services.
All thses services should aim to privide an integrated service for the child so that parents perceive the provision as "seamless". They should keep one another fully informed about the action taken in support of the child. Under the Children Act 1989 and the Education Act 1996 schools,LEA,s, the health services and the social services departments of local authorities are required to help each other in various ways.

After i read this out to the LEA SEN officer she started stuttering and shifting her papers about and our psych piped up "Yes its something that most LEA,s will try on, to disregard what it says about working with people in private practice.
Anyway it worked because seem to have had a complete change of though for some reason !!!!
