Not even 48 hours away! I can't belive they are allowed to do this!!!

If they get it, they will regret it. I will get more indi reports done.

He's been a twunt. Of course he knew it would be pm because the other day he told you that the hearing would go on for days!!!
He clearly doesn't have a clue. I really hope he doesn't get the adjournment.

If he didn't tell his witnesses it could be morning or afternoon, he's a total idiot. Anyway, he was presumably given the time at least two weeks ago, why has he left it so late?

Also, if he wants a witness from the school and the original candidate isn't available, surely he can get someone else?

Is the hearing tomorrow? If I were you I'd phone the tribunal now, they must surely have made a decision.

Phew! Tribunal has refused him the adjournment!

They have sent back my late report but phoned telling me to bring five copies tomorrow.

Feel great now, he's running scared - time to load both barrels tonight and re read my entire bundle. My ep has noted his nhs salt report is very shakey and has many flaws.

I will presume its in the bag from now on in

they sent my late evidence back as well but on the day they did accept it so it can be done.

try and now just focus on tomorrow - easier said than done I know and go through your bundle - remember to take a photo of ds with you and post it notes and snacks as well. im sure you are going to do brilliantly and have everything crossed that they will concede it

Grin You can apply for your evidence to be accepted at the start of the hearing. Point out when you shared it with the LA as if they have had it a while its harder to refuse. Good luck And be prepared for tribunal to given LA some leeway on the day- often it looks like they bend too far but sometimes I think that is so if they find against the LA the LA can't find any basis to appeal Our panel let the LA have their way too much on the day but then the decision found in our favour on every point.

Just read the paperwork from sendist. The lea have been asked for adjournment on the day :0( let's hope I don't get all the way there for nothing. I will not be pleased

you would think not given that the directions are clear so this doesn't happen as it is a waste of time and money on everyones behalf - I would say if the tribunal are minded to adjourn it then you should be awarded costs as you are ready to go and the LA excuse is rubbish. I wish in situations like this the tribunal could just order them to issue a statement as the evidence in the papers should be enough

They might try asking again on the day, but I suspect the tribunal will be really reluctant to adjourn once everyone's turned up. Make sure you look really upset if they raise it, and point out how you've had to make massive efforts to get there, arranged child care, etc etc. If they say they absolutely need some particular witness who can't be there, point out that they have admitted that they didn't read the tribunal documents re the timing of the hearing and only started sorting out witnesses recently and you and your child shouldn't be prejudiced by their inefficiency - also point out that he certainly will be prejudiced if his SN aren't dealt with now. Also point out, if it's a school witness, that surely they could send a substitute, e.g. the head, deputy, SENCO or class teacher.

If they're at all inclined to listen to the LA, you could suggest that at least you make a start on the hearing and just have an adjourned hearing for the missing witness. But that should be an absolute last resort.

If the hearing does go ahead and concludes tomorrow, do make sure you ask the LA rep as you go out what happened to his prediction of a hearing requiring several days Wink.
