GRRR - DPA request

We are taking the lea to tribunal over their refusal to give my ds a CSP. It seems they must have based that decision on absolutely NO information at all as the DPA request we put in has come back with ONLY the forms we sent them!Angry Those minutes they took at the meeting must have been torn up and all emails deleted.... Hmm. Do they really think we will be fobbed off so easily? And I paid them £10 for it!

Most LA say that the decision IS the minutes.

It's bollox but they have all been getting away with it for years. Apparently there are verbal contributions from key people who they will not disclose.

Transparency anyone?

I bet they will be re-found and the contributions disclosed at the tribunal! My other thought is they may shift the papers around; my DPA request was to the council but the HT did some of the coordination (not the decision though). So, maybe these papers have mysteriously made their way to the school but will be sent back if I request anything from the school...

Our LEA did the same for our DPA request only sending the information we sent. I contacted the information officer at our council and told them I would report them to the Information Commissioner if I did not receive all of the data on my DS. A week later I received another 54 pages!

However, I was not successful in accessing the minutes from the meetings because apparently they don't keep them Hmm. Transparency indeed.

We did a request to school and ended up ringing my case officer who eventually managed to get everything sent out. Oh and the school was upset that I didn't speak to them about it! I'm horrified that schools do not know the data protection act but its even worse that the LEA don't.

ive had it with the LA where emails were deleted as the LA ruled they were 'information only' there were documents missing so I asked again for them detailing every single document I could work out was missing - I also then got them about a week later with some silly excuse. other meetings were not minuted by the LA as they were 'case discussions' or something so they said there was no need to.... Im about to do another one for my daughter but am waiting so that they keep on writing in her file what evil cunning plan they have ahead for her and what meeting are being held and then will quietly request it

Yes I have found that both school and LA did not send all that they should have done. When I complained to the school that they had not enclosed all the necessary paperwork I was threatened with legal action against me for 'slander' for daring to claim that the school would do such a thing.

Later on a tribunal judge had to twice order them to provide the missing paperwork. They finally begrudgingly did so claiming that they hadn't provided these earlier because they had 'not been asked for them'. What part of 'all paperwork' did they not understand I wonder? Hmm

So definitely not just my LEA then... Think I will send a stroppy letter tomorrow and copy a few people in. My last DPA request took over 50 days for them to respond with one report. They sent a few more bits a fortnight after that but I didn't push that one as had other fish to fry at the time.
