Can anyone tell me what happens if the LA dont come back to us within the 6 week timeframe? Have they "breached" some kind of obligation?

What should our response be?

Any experience or knowledge much appreciated, thanks.

Yes, they've breached a statutory obligation. You could threaten to report them to the Local Government Ombudsman or to take them to court by way of an application for judicial review in your child's name. If you had to take legal action you could get legal aid in your dc's name, but usually LAs cave in before that stage.

If you have parent partnership get on to them. You could also email your case worker, cc ing the head of the lea and your mp. My lea did the same with the nil and I got a pretty quick apology after doing all of the above

Thanks - is parent partnership completely independent, or part of the LA? I have seen details of how to speak to them but didnt really know what purpose they fulfilled.
