Just that really Grin! The date for final evidence to be due in to the Tribunal was this Thursday - the LA hadn't submitted any evidence at all...

I was wondering how they were going to find evidence that DD was progressing in school and being well supported (as the LA initially claimed) when DD (age 9, HFA, selective mutism, anxiety) hasn't been in class since late Jan....

Thanks for the advice and support of so many of you on MNSN so far (!) - I know there is a journey ahead. Thinking especially on those still on the refusal to assess 'hurdle' - I know your tribunal is next week bjkmummy

well done pannetone - so pleased for you and so glad that they have made the right decision.

my LA didn't submit any evidence at the final evidence stage so my tribunal is going to be interesting! mine is a week today.

I love it when the LA make the right the decision - just a shame that they have made you go through this and not made the right decision at the beginning as its clear she need assessing - mad how they drag it out.

We are in the same place as you. Spoke to the LA yesterday and they are just starting to gather their reports apparently!!

Thanks for the 'well dones'! Smile It is pretty ironic that we all compliment each other on (often finally) getting the 'result' that was clearly needed in the first place. My LA were attempting to 'defend the indefensible' saying DD was being supported by her school when she hasn't been (and they were fully aware) in class since last Jan.

It is obviously good news that my LA has agreed to assess, but in reality they have delayed DD getting the assessment and support she needs by a whole 4 months. And I am well aware that we may have to still go to tribunal if they decide not to issue a statement, or even then appeal the comtents of the statement - yet more delay....

Feeling a bit battle weary today - I really do need to get on with putting in my parental request for DS3 (also HFA, anxiety) to be assessed for a statement. He has been off school since Jan as well but I reckon my LA will still come back with the standard response that the school have the resorces to meet his needs....

Ironic yes that we celebrate the begrudging SA that should never have been refused in the first. Yes, they have 'won' delay but we have won more for all those desperate for help who see that 'success' is real, that real people with real DC have found ways to make things better --by learning how to get through the shit along the way, and it can be a long journey.

(And helps people see that the alternative may realistically be to watch your child suffer, banging your head against a brick wall - for years. Hats off to you Lougle - so happy that you and DD2 are happy with your choice - excellent modelling of the decision making processGrin)
