I know that under the SENCOP academic attainment doesn't rule out statutory assessment

.........Para 7:39 "academic attainment is not in itself sufficient for LEAs to conclude that a statutory assessment is or is not necessary"....

However - my local authorities guidance says very clearly that the threshold for assessment is that educational attainment is assessed as being 3 national curriculum levels below expected levels.

DS is working at expected levels, but he has asd/anxiety/can't function without one to one support etc..... how should I play this? Do I need to think about getting ready to appeal already? What should I say in my application for SA?

Ignore that from them because they are writing a lot of BS. Such blanket policy is not allowed in case law and they know the law anyway. They're just trying to put people off applying!.

Use IPSEA's letter on their website for applying for a statement www.ipsea.org.uk and read their website anyway as it has lots of useful info on it. I would also name and shame them to IPSEA as they are very much interested in the many wrong doings of LEAs.

I think I will try to ring IPSEA. Just wondering what to say in the application - whether to face it head on, or to ignore.

Are there any disadvantages in facing it head on and saying ds is working at expected levels and that that makes no difference as to whether they should assess?

We have just been to tribunal for exactly that reasonlevantine The panel allowed our appeal and ordered the LA to assess. The LA's only reason for not assessing Dd3 was her NC levels which are average to above average.

I made a big thing of how much extra provision is in place at school just so I can get her there.

Go for it and dont let them tell you he doesnt meet the criteria *attila is right it is BS!!Smile

I didnt even mention NC levels! I concentrated on the things Dd3 struggles with the most. I knew the LA would bang on about how well she is doing academically but that is not the whole picture.
