Do I have to know about and consent to LA visits (run up to tribunal)

DS2 attends school in a different LA to my home LA. I am appealing refusal to assess.

I have just been told that a relatively senior person within the home LA (was due to be a witness at DS1's tribunal) visited DS2 in school, spoke to him and teachers and observed him in class. She has apparently given a copy of her recommendations to the head/senco. Another person from the home LA is due to go in next week. I have emailed for confirmation as the head nobbled DH at drop-off and he thinks it was an EP but can't be sure.

I have had no communication from the LA and no communication from the school until today.

Does school LA/home LA make a difference in terms of whether employees of a neighbouring LA have the same rights of access?

Do I have to be informed?

Do I have to consent?

And btw, I was concerned to note that unknown person (we are told was person y) visited ds in school on date x without notice or seeking parental consent.

Could you confirm that the visit was officially authorised, that their crb is upto date, and that they are still a LA employee in good standing?

We appreciate your continued suspiciously new-found interest in ds, but are feeling uncomfortable with the fact that complete strangers may have had substantial contact with him without our prior knowledge or consent.

You might find you've signed a blanket 'anyone can do anything for any member of the family' form years back. Ever had a CAF?

I have (on principle Wink) never completed a CAF and have only consented to EP assessment as part of SA.

Don't say this! It's what you're asking the tribunal to order! I think I'd go instead for something like "Unless you agree that dd needs statutory assessment I would suggest that you defer your assessment until the tribunal has made its decision."

Filing comments for future use. Am still at the stage of the LA requesting consent, then there will be a further exchange of correspondence asking them to give reasons rather than just confirming it's in relation to appeal of refusal. Then I will have to get advice before I can consider my decision. They want me to consent by tomorrow as response is due on Wednesday. Given their preference for using snail mail I think they may have left things too late. Shame.
