LA response due today - shall we have a bet on the time ?

All quiet so far. My curtains are closed and my door is locked. I'm feeling ill today so curled up on the sofa with a blanket and iPad. I think they will hand deliver it later or maybe email it as I have a feeling they've instructed a solicitor but i could be wrong.

I'm going to say it will be hand delivered around 5pm tonight by an LA officer on their way home.

actually nennypops I have served them all - the child views ipsea advised me to send them as they were concerned that the LA wouldn't as they were insisiting on a second set. there is also quite a lot of stuff which I know the LA have and they haven't served it - its all the stuff that could cause them some problems. its not an issue I guess as I can serve it myself. I need to chase up her school records as well as school haven't sent them yet. ive been out this evening to a talk about the new EHCP so have had a break from it all - its all fine actually and what they have sent is so weak that ive got a reasonable chance and nothing to lose by giving it a go - especially after listening to the talk tonight she would have no chance at all come sept. still worrying that SA and SA plus are going. this is my one and only chance to try and get her help - it just frustrates that in the response at no point do they even mention that she is nearly 4 years behind

These la people are quite sneaky - u really have to keep your wits about you. They've served their la criteria for statementing. after going through it they've not served half of it namely the part where it's gives the number of years behind a child has to be. Thought maybe their photocopier had had a moment but no, it was definately their intention to serve only part. As I thought yeterday, pp copied my daughters views and handed them over but when I got home I thought something is missing and sure enough the whole document wasnt copied yesterday - think that may have been an error though

The page missing referred to the future where she was asked what would make her happy and she said more help with my dyslexia.

bjk I would make a list of the missing items and left out sections and write to them and the tribunal querying why they were omitted (whilst serving them yourself).

Of course it is obvious WHY, but though lots of people don't know this, the tribunal isn't about you against them with a judge arbitrating, it is about them providing ALL relevant information plus details of outcome that will lead to the right decision being made for your child and the Judge/Panel's job is to 'peer review' iyswim. It isn't supposed to be a strategic game.

It's madness, they've done a chronology and mention emails/letters but not served them as well - the letters/emails are quite crucial. Their case is that she is making progress but provide no evidence of this and nowhere does it state how far behind she is to her peers. I know that it's meant to be all cards on the table and everything should be put before the tribunal panel but the la seem intent on manipulating what is seen. They even goes as far to state that assessment not needed as unlikely she would get a statement at the end of it. That may be true but without an assessment how would we know. My EP report states she is significantly under achieving. Anyway I will serve my form next week and then slowly gather my evidence. She is seeing an independent salt tomorrow and that will be interesting to see what they say. Then the following week the OT is seeing her.mthe case statement is pretty pants really and nothing in it that I can't deal with.
