Mobility denied, what comprises an appeal?

Hi my boy is ASD he is 3. They have denied him mobility. I appealed and they denied him again. They don't give any reason. Now it must go before a panel. Does anyone know if I, as the parent has to attend this panel? I dont think i would be able to contain my anger. I know plenty of 3 year olds who have received mobility.

I went to appeal for dd. I went before the panel, you can get take someone with you but I'm not sure if someone can go instead of you IYKWIM. You don't have to take your child.

The panel is ususally 3 people, a medical person, a solicitor/lawyer type and a disability advisor. THe surroundings for my hearing were very formal (in a court used for immigration hearings) but it isn't always the case. The panel were lovely and really tried to make me feel at ease, the doctor in particular was very good.

You can ask the DWP for the full reason why you were denied, and you can address that at the appeal. If you go to appeal they will send you copies of all the paperwork.

Have a look at www.bhas.org.uk. There's a step by step guide to the appeals procedure. Go for it - you've nothing to lose.

Have you looked at the info on the NAS website MMDDWW? It has the court case there that you need to quote. I quoted that on my application (as in "when considering my case please refer to courtcase number......") and was given higher rate.

You don't have to attend, it can be done as a paper board but people generally have a higher chance of winning their appeal if they attend in person.

we are waiting still for dd2 appeal for all DLA(has had DLA for 18months, it was removed in march). i wont be going to the appeal as Peter will more than likely be home and its a PITA re-organising carers and sitters for the kids.
