Ofsted - no need to report discrimination in inspections

Well the outcome of an Ofsted investigation is now in and the upshot is that it is fine for a school to discriminate against a child, proven in a SEN EQA tribunal, for the school then not to comply with a tribunal order to disclose liability to Ofsted and that they will be reported as promoting equality and working in an inclusive manner in their inspection report.

What a joke, I am so angry that my child is perpetually seen as unworthy of basic human rights.

Oh, how appalling. Can you ask for a review of the Ofsted decision? These bodies will try and tie you up in knots.

How on earth have they explained it away? I find that utterly appalling, really I do. Can you write to the local newspaper with details of the Tribunal judgment?

So sorry. You were right to have pursued it though and I like to think that behind the 'official facade' heads have rolled, lessons have been learned and someone somewhere has resigned with stress.

That is shocking. A letter to a national newspaper as well as a local paper? Who does Ofsted report to?

I don't think so. We see this thing a lot on this board. Everywhere you turn are closed doors and cover-ups. Some sinister but most IMO arse-covering incompetence.

Angry I was just pondering whether or not Ofsted would want to know about a school that discriminated - apparently not!

2tired - did the school apologise for the discrimination at all?
I am in a situation where the school have been found to have committed multiple acts of discrimination. They had stated that because of their reputation with the LA and Ofsted it is clear that they were not a school that would ever discriminate against a child! Hmm They have also threatened us and also attempted to discredit us.

They have been ordered to apologise to the child for the distress caused but have failed to do so. This is a school that have claimed that we should have apologised to them for our disabled child upsetting their staff!!

They have acted unlawfully in other matters and clearly think that tehy are above the law!

I understand my only recourse now is to go to Michael Gove. Ipsea suggested that a JR may be appropriate but I'm not sure if it would apply to this sort of thing.

Regular - what decision have they suggested you JR?

2tired - if there is some kind of review procedure you could ask to undergo that or see someone about a possible JR of the decision but that would be costly. You could write to Wilshaw himself or get your MP involved?

I think sunlight is the only disinfectant in these circumstances when oversight bodies let you down.

I am so sorry because it is gutting to be let down like this.

The local newspaper is in the pocket of the LA they won't write about it, the politics stink! But there is clear evidence.... A tribunal order naming the school and a subsequent inspection report with claims that are demonstrably false.

To be honest I really am so cross that I will find a way to pursue this, I am sick of the dishonesty. I know about a lot of poor practice issues in this LA through work aswell as personally.

Have moved out of the family home and am now in the constituency of a labour MP, I have requested a meeting.

No explanation whatsoever IE seems Ofsted don't justify they just do or don't do as the case may be.

IE - the decision to not apologise for the discrimination as has been ordered. As I say I'm not sure if this would be feasible at all. It seems ridiculous that we took this to tribunal to get an apology and they can just ignore the order.

2tired what about any national newspapers- would they maybe be interested?

I'm so very sorry you've had this response. It's massively disappointing. Ask them how you can make a complaint but in the meantime you could explore the papers. I suspect the Telegraph might be your best bet as they tend to be anti Ofsted and anti state school generally.

You could tweet the decision if it isn't confidential. Be factual and name the school and quote from the judgment. Don't veer in to opinion or anything they could call defamatory. If it is written in the judgment it can't be disputed. Tweet that they refuse to apologise and that Ofsted won't do anything.

Get a blog and put this all on if there is no confidential info and tweet it and tweet at newspapers and Ofsted and political commentators or charities.

Approach organisations who may help

Will try the telegraph IE to see if they are interested, I am no good at tweeting I really don't know how to but I could ask my oldest son to help.

If any info is deemed confidential by SEND, they would state that wouldn't they? They haven't so I presume it must all be open to quoting? Really appreciate your advice IE, thanks

IE bizarrely the Order states that the school must send the orders to Ofsted so that they can monitor future discrimination! The chair of governors has just written to me to tell me they omitted to send the order of liability to Ofsted and have just done so!

It just feels that you get sent from one body to another to me!

I suspect they simply alerted the school and the LA that I have raised it though they didn't use my name they assure me..... Like that matters or they wouldn't work it out!
