Anyone here requested a new tribunal panel?

Hi all,

My case ( or cases) are rather novel and very technical, which even the judge admitted.

Without getting into too much, my solicitor who has never experienced the headache that has come along with my case or even case like mine in general is advising we need to request a new panel as they are being biased beyond anything she has seen/heard, to the point of trying to go against previous orders and directions and " helping" the defendants with their case.

We are both trying to find out if there is anything/ case law out there that can assist us with how we go about it ( if we can)

We are also concerned about the make up of the panel and again not sure if this is something we can ask the tribunal big wigs to consider as I think this is fundamentally the reason why I'm getting this hostility and lack of impartiality from them.

Sorry, I've got no experience that'll help here. We didn't know who the panel would be until we turned up on the day of the hearing. One of our witnesses had strong suspicions that one of the panel members might have done consultancy work for the LA's preferred school, but 'might' was as far as our witness went - it was a second-hand suspicion, nothing more.

Your panel sound bizarre - are they not just setting themselves up for an appeal with conduct like that?

Unless On a point of law issue, then I'm slightly stuffed, which with the way things are going unless the judge bucks up her ideas and thinks with her legal head rather than her wing members head I should be able to challenge her decision if unfavourable however as I mentioned my issue are in stages and not a straightforward 1 or 2 day hearing..

We have since made enquiries and good out come or not complaints will be made, as it really was ridiculous..they weren't even trying to pretend to be impartial.

Has your solicitor formally asked them to recuse themselves? They'll probably refuse but you need to have that request on record. I think she needs to look at the case law on that in general rather than anything specifically relating to tribunals.
