IPSEA's take on it

DFE letter makes clear is voluntary and parents can request assessment under the old (present) system - if you scroll down to Sept 13 you can download Stephen Kingdom letter for pathfinders.

They cannot force a EHC plan on anyone until after Sept 2014

There is no forced transfer right until Sept 2014. However, what some pathfinder authorities are doing (Hampshire, for sure) is offering a concurrent system.

"From January 2014 all families across Hampshire making a new request for a statutory assessment with children or young people from birth to age 25 will be offered the opportunity to take part in the trial of the EHCP.

The new EHCP will become law in September 2014, and therefore the current legislation and statutory protections will apply for families completing an EHCP trial until the revised legislation is in place."

Thanks. I'm not certain if the details but a friend in my LA seems to think that she's not been transferred without her agreement.
