Evening all..,

I've been MIA as I've been busy with my sen issues.

Last I mentioned there was the palava with the LEA changing their minds ( don't want to go over it again too much)

This is shady beyond any thing any solicitor has come across, Anyhoo barrister is all up for fighting this, BUT solicitor is less keen as if this goes to the high courts ( which it will if it goes ahead) and we get a stupid judge that rules in the LA favour the negative impact it will have on the UK sen system is huge which no one wants but it's at the expense of my sons education/right to justice. With that said if it rules in my favour it will set the precedence if other LA try the same tactic in the future ( although from my understanding/research no others have even thought of it until my lot came along)

Barrister thinks we have an excellent chance of success but it's just that small element of doubt that is worrying the partners of said law firm so they are having a meeting over it. Barrister is more than aware of the major implications if we were to lose, but still thinks we should fight it as he believes there is a strong argument, but we know what these things are like..no guarantee

Only I will have a case this bloomin traumatic!

Good grief. Poor you.

Imagine you have made the decision each way and try and live with it for a bit and see how you feel.

Don't though worry about the cost to the SEN system. It isn't your Ds' fault that it's all bollocks.

Left to me I will go ahead! It's the solicitor that needs to get on board and that the not so straight forward part.

I've got my macroons and will take comfort in those tonight and start the fight again tomorrow, I'm just feeling a tad deflated :-(

The whole system stinks. You are damned if you do, and damned if you don't.

So on that basis, you have no option but to do what is best for your child.

senmerrygoround · 06/11/2013 08:59

Absolutely agree with others, you need to concentrate on your child.

hoxtonbabe · 06/11/2013 11:36

I am concentrating my my DS, however if the solicitor is saying it could make caselaw that will allow LEAs to get away with even more shi* (but equally also make caselaw that would have a positive impact should it go my way) then I really just need to sit tight and hope for the best. I need a solicitor on this issue, no 2 ways about it as its the high court, so at the moment my DS future hangs in the balance of the solicitors firm

I cant just jump ship to another solicitor due to funding etc..
