Didn't have to go to tribunal but thought all along I would have to. I wouldn't have taken my son but would have taken his teacher and ed psyc if it had come to it. Good luck!!!

This is for refusal to assess right?

StarlightMcKenzie · 24/10/2013 14:31

If you're just appealing now then say Indi EP, Indi SALT, Indi OT tbc.

Book an EP for just over a month before the tribunal just in case but honestly, I cant see you getting that far.

God that sounds expensive! I have a private salt working with him, and a friend has a friend who is ed phyc who wants to offer me free help ( might not extend to any kind of assessment)

Yes it's for refusal to assess

School used the magic words "unable to meet ds needs" at parents evening. Great and horrible both at once.

I hope the lea turn in down before the big t but going on past experience I think ds is heading for the manure pile of life.

You don't have to actually use them. You just say that they are to be confirmed in order to show that you might.

You need to put in writing what they said at parents evening and ask them to refute it if it isn't true.

If it is clear enough that there is plenty of evidence before tribunal, by the LA insisting upon it the tribunal can order costs to be paid to the parents.

You will however, probably need an Independent EP at some stage, sorry.

For refusal to assess, I named indie OT, SALT and EP. LA backed down a couple of weeks before Tribunal.

For appeal against the Statement - which did get to Tribunal - took with me indie OT, SALT and EP. Solicitor advised not to take DS because the most needy of children will suddenly become angelic, quiet and compliant when faced with a Tribunal. And also you would have the added worry of personally having to look after them during the hearing.

Tribunals very rarely (if ever) order costs - even if there's plenty of evidence. My LA tried to bring a costs claim against my solicitor, my solicitor brought a counter-claim because of the time the solicitor had to take in defending themselves. The LA's claim was so full of out-and-out (provable) lies that it was laughable. Judge dismissed both claims.

You've not met my two. No sense of occasion :o

I am thinking of getting everything I can backed up by indi star at some point. After my private and nhs reports being so far apart in their assessments. My private salt is ( as they all are) ex nhs, has no reason to overplay ds levels ( she said has where approx where the nhs put him when we agreed to then do therapy ). I just can not trust any body who has a vested interests in signing kids off to reduce waiting lists. However I do trust people still. I'm not totally paranoid ( yet). I just need to know honestly where I stand
