Dd2 was supposed to start school last September but there was a debate over whether ms and full 1:1 or a special unit was required. We'll it was decided to go ms to see how she copes. But school are not pulling their finger out and sorting dds 1:1.

I am very pissed off dd is now 4.3 years old.

Has she got a statement?

Crawling · 08/10/2013 09:45

No we were refused a statutory assessment.

On what basis?

Did you appeal?

Crawling · 08/10/2013 09:49

There was confusion that the ed psych said no additional support was required by the time I sorted out what was going on the time limit for appeal was passed.

Ah well, so apply again. Do it today. It might not get you a statement but it will kick them up the bum.

Can I really apply again?

Yes. The outcome will most likely be the same, though you have additional evidence that the school cannot meet her need i.e. they don't have the promised 1:1, and she is currently out of school on this basis meaning she is not receiving an 'adequate' education, her legal entitlement.

I would call IPSEA though or SOSSEN.

The school/LA will tell you that you must wait 6 months. This is NOT true so ignore them.

Thank you so much I will get right on it.

Unfortunately as she's not yet 5 she's not yet of compulsory school age. However, if all other children of her age are in school you could definitely argue that this is disability discrimination. Perhaps if you mention that it might wake someone up?
