Summons for tribunal witnesses

Has anyone ever had to request a witness summons at all? A key person,whose actions in several incidents may have resulted in alleged discrimination, has strangely not been included on the attendance list. It's not someone I will be able to contact myself to request attendance. Any advice would be useful.

Would they be on your side or against you? Have they ever lied before?

It is usually a better strategy to get a witness to this person's behaviour instead of asking the person directly and risk them denying things. It is worth noting that usually, the judge will take the word of a professional as truth.

Thanks Star. They would be against us so, in hindsight, probably not helpful having them there.
Their own witness statements show a failure to act appropriately or follow recommendations so hopefully that will suffice.

I would guess that their own side are not calling them as they have concerns about the evidence they may give and that they may damage their case. my LA after making a song and dance about getting their own OT report for 'balance' against my OT (report would come back even worse than our report!) quietly at the last minute didn't call her. I learnt later form the OT that she was dropped as her evidence was the same as our OT and LA didn't want to risk her giving evidence for us. Im sure by her lack of attendance the tribunal were able to see straight through it. I too was solely tempted to call someone the LA left off the witness list but decided to concentrate on my witnesses/evidence and glad that I did now.
