Re compatibility other education of other children

The authority has said the academy has refused my son has it
'would be incompatible with the education of the other children with whom the child will be educated'.
But they can meet his needs.
He has statement for dyselxcia,
Can any one help as to what would they may mean by this. they do say they are oversubscribed.
Has anyone been to tribuanl with this sort of refusal and would you recommend representation.
I am at a lose what to do next or to prove my case.

Mainstream schools and academies are entitled to say that they can't take a statemented child if his admission would be incompatible with the education of other children but they can only do so if they can demonstrate that there are no adjustments they can make to prevent that. I find it highly unlikely that a dyslexic child would prejudice the efficient education of others, and even more unlikely that they can't make the necessary adjustments, and there is lots of case law supporting you.

There was a batch of cases last year concerning another academy, Mossbourne, which tried this argument and failed. Have a look at this report - www.theguardian.com/education/2012/may/24/academies-refusal-pupils-special-needs.

On the other hand, though, you need to think about whether it is actually worth your while forcing the school to take your child if that is their attitude.

Mainstream schools can and do refuse to take on dyslexic children. It happened in my DS's case. The LA DPA material showed up info from one of the two mainstream primary schools within walking distance of my house. This info was a "no - it would be incompatible to other children" to the LA placing my son in their school. To my great surprise, the DPA material did not show up any info as to the second school. But as the LA cherry-picked info they disclosed, perhaps it was hardly surprising it wasn't uncovered. The LA must have consulted with this 2nd school too, and they also said no. It explains why the LA then went on to try and place a severely dyslexic child in a speech and language unit over 20 miles away from my house

However, that said, I would agree that if a school didn't want my child, I won't want my child anywhere near that school!
