DS assessment has been turned down by LA. They have made recommendations for the school, which they say school need to meet.
Had a meeting 2 weeks ago with headteacher (SENCO couldn't make it),and LA. Head lead me to believe these recommendations were going to be put into place. So I felt I had to wait and see if these helped DS,and LA said they wouldn't do anything else until the school did anyway.
Spoke to head this morning and she said SENCO didn't think these recommendations would help DS.
So what do I do now? Confused
Help.

You confirm in writing with the HT what she had told you that the SENCO has said and then you file an appeal against refusal to assess including that letter.

Have you been on the IPSEA site?

They should be able to help you with the next steps, if not, find the forms for appeal and ask on here.

It might look like a daunting task but there are some people on here that have done so many appeals they can do it with their eyes shut so don't feel overwhelmed. It's not as hard nor as scary as you might think.

It appears to actually be standard practice to refuse and make parents appeal atm.

charlieboy6 · 25/06/2013 10:32

I'll go and have a look on IPSEA now.
I think you are right. They just hope some parents don't bother to appeal.
Thanks again.

Also look at the SOS-SEN site - www.sossen.org.uk/. They're running a workshop in September for appeals against refusals to assess.

You will need to appeal within 2 months of their decision not to assess so be sure to get the paperwork started. You can add to the evidence as time goes by but obviously the more you put forward the higher the chances the LA will back down without needing a hearing - and many do.

We appealed & they backed down almost immediately. We now have a full statement. You can do it,stay strong :)

Ditto we appealed and as soon as they had date from tribunal they backed down
Took a short call to ipsea helpline to know what to write on appeal form
Also sent a load of medical letters etc, IEPs etc all helped

NAS provides good info. I have used their tribunal helpline before, but I can't find the link.

The link to NAS is
