Do I push to get ds on SEN register or not/very confused?

My ds has 3 x SPLD, the worst of which his processing speed in 4th percentile. Independent EP thinks he should be on SEN register, consensus seems to be at action level, for classroom consideration and extra time in assessments. Looked at COP and suggests must show that attainment gap widening from peers, which I think it is in maths, but not got records of NC levels going back long enough to prove.
Predicted to get 4's in year 6 sats, but in hols did some papers and marked and scored him at a 3 as he only did 2/3 of paper or less, in normal timings. Senco says that he doesn't tick enough boxes for their broad and narrow descriptor tick lists for SPLD to go on SEN's register. Don't know if the tick lists is a local LEA thing or government policy. Senco says that he can access curriculum and isn't 2 years behind. Apparently this two year behind thing is rubbish according to BDA who told me that according to Education Act 1996 and Equality Act 2010 he is disabled and should have his needs met. Want him on the SENS register before he hits secondary as feel that he could go off the rails with a few unfair detentions and misunderstandings in those early weeks. Primary wanting me to just approach secondary and sort it out with them. Trouble is have lost confidence in Secondary as far as SENS goes, due to previous experiences so would rather sort out with Primary, as at least they listen. Sorry for long post, but this is driving me nuts as I just don't get the policy.

Transition meetings coming up and have meeting with Primary School Senco and Head this week, outlining my concerns that he goes on SEN register before hitting Secondary, they want to meet with me and help me achieve this if its just, which is really great, I didn't expect this.

If I look at the COP I would say he qualifies to go on Action or even Action Plus as EP involved. But if I look at Oxfordshire's Descriptor list, he doesn't qualify even for Action as his literacy skills are not poor enough.

Does the COP have the final word on this? The schools seem to go on Counties Descriptor lists.

SENCOP overrules any council or county descriptor list; that list you mention actually sounds unlawful. Did you mention such a list to SOSSEN?.

No I didn't Attila, but perhaps I should give them another ring. I was told by PP that the descriptor lists were to even out the provision between the poorer and richer areas of the county. I didn't get this. I would be considered white/middle class and educated, so something else to put me on a guilt trip, that my child is privileged. Surely if my child deserves to be on the SEN register this should be irrelevant and by making it impossible for my ds to go on Action/ Action Plus, how does that make it easier for poorer underprivileged kids, don't get it.

In section 5.54 of COP, suggests take action through SA + when consult with specialists. But says involvement of specialists need not be limited to such children. Says can be used in diagnosis or to stop the development of worse problems. THere is their opt our clause for not putting on SA + just because EP involved. Is my thinking right?

Latest in the Saga, Primary says he doesn't qualify to go on SEN register and have just had it confirmed that Secondary won't put him on it either.
Head of Primary, who is lovely, felt there may be some advantages in him not going in on SEN register, but tonight I feel frustrated. It all seems to go on reading skills. As his are good, the fact that his processing speed is so low, the EP said it's technically like being deaf, his WM means he struggles to get things down quickly so writing is difficult, mental maths is badly impacted- non of this counts as he will get 4c's at SAT's. He is a really bright lad and I reckon he could have got well into the 5's if he hadn't got these probs. It seems to me like he has to fail badly before they will put him on the register, by then I won't be able to get him on the school bus. I see the gap widening quickly as there will be no mind-full teaching, little class-room or homework considerations as to them he clearly has a trivial prob.
