OK well the statement came yesterday. Odd really. They have pretty well ignored everything we said n our response to the initial proposed statament. They have refused to name a school yet for when he goes to school, but said he should stay at current nursery until September (we currently send him to private nursery with ABA shadow one day a week), and then go to reception (without saying where they think that would be).

(We have a specialist ABA school in mind and will take them to Tribunal on this point, I think).

Then they have said he will have 5 hours a week of a teaching asst at nursery. We will of course be telling them we want the current tutor to continue going with him (I suppose we will have to offer to top up the difference between what a TA would cost and what she costs).

Then, although in Part 3 of the statement they clearly state that he should be on an "intensive VB programme", in an accompanying letter they say that this does not apply to any education he has at home. Not sure how they can say that really (at present he has a home programme of close to 30 hours a week, they have ignored my request for them to quanitify what an intensive VB programme means).

So bascally at the moment it looks like we will get some money from them for the one day a week at the nursery plus the cost of 5 hours equivalent of a TA, and that's it really. We are then going to have to start appealing now to try and get the school we want.

Anyone got any comments.

On the face of it I think you;re going to have to appeal this because it sounds dire.

Proposed statements have to be both specified and quantified as per case law; this does not sound like this has happened here.

I would contact IPSEA and read Parts 2 and 3 to them in their entireity. They should be able to advise you further on what it should actually state and advise you about tribunals.

Part 4 naming the school at the proposed statement stage is usually left blank for you to complete.

Thanks for that Attila. Yes we were in any case fully expecting to have to appeal to Tribunal. Just trying to figure out the details (and not get too angry/stressed/indignant to react properly!)

This is the final not the proposed statement, we named a special school in our response to their proposed statment, where they had left Part 4 blank, but they have refused to put that in.

I did get advice from IPSEA at the earlier stage, and am fully intending to get back to them again in the coming week.
It's just all horribly stressful!

It might be time to show some legal fangs, or it might be better to keep that for the main event. I showed mine early, then sort of backed off - "let's try and do this amicably". Mind you, my battle was easer cos wasn't against such a harsh economic background. I would get F in.

Dudes....get fiona in. I am not having to go to tribunal just cos she is copied in every e mail I exchange with LEA. And my case is not as complicated as yours. Get her in now as she has been saying no to people saying she is busy.
