Can I just ask what may be a stupid question, for those who have been there. Our final statement is due on 21 March, we are fully expecting to go straight into appealing the provisions. The question is: while the appeal process is being gone through (which I know can take many months), do you in the meanwhile get the provision that is on the disputed statment, or does everything go on hold?

I ask because our proposed statment had "intensive VB programme" (not defined further) on it and it may be that something of that remains on the final statement (while fully expecting that it will be completely inadequate, given our DS has a 30-hour home programe at present, that we have no intention of cutting back). Would this mean that they have to immediately start coughing up something, if they have agreed to any degree of the programme?

I would say if they finalise it, whatever is in the finalised statement has to be provided whilst any appeal is ongoing. They may of course drag it out but legally they should be providing it

we had this situation. if the statement has been finalised then the provison as outlined in the statement should be given as long as the appeal is pending.

That's helpful, thanks (any help would be welcome, funding the 30-hour a week programme at the moment totally from my own pocket, feeling very broke! I know whatever they put in the statement will be likely to be woefully short of what we are doing, but something would be better than nothing!).

Be prepared for them NOT to deliver what is in the final statement. It's illegal to do this but they won't care. However, if you deliver it yourself during the time they are supposed to and keep a copy of invoices you may get it back.
