when suing your hospital for med negligence on behalf of baby - do you still use it?

Do you still see the consultants there (even if they are involoved in the case) and take your child to its child development unit? Or do you get referred elsewhere? and would that then prevent you from having access to any local cdcs/services?

I ask because I had my baby out of area, and we have since been referred back to our local area, therefore don't have to go back there again. But now we are seriously thinking of moving to the area of the hospital we are suing. I would rather ds not set foot in that place ever again, but don't know if this might jeopardise ds's chances of making full use of local child development facilities.

Does this make sense?

I (vaguely) know someone in this position. She did use the hospital for a while, but then had other problems. Now she refuses to set foot in the place and takes a 2 hour journet to get to the next suitable hospital (teaching etc). Could you talk to your current consultants and ask them their view?

yes I do. as the problem was with the birth and that department. I have no choice but to continue and have no problems. If I was planning on having another baby(which I am not) I would not use it then.

You have the right to a choice of hospital in any new referral, so you don't have to use the hospital in question. Obviously if you live in a remote area, you may have no alternative, but it doesn't sound like that's the issue.

Hi JJ, I will ask for professional opinions, but I won't actually meet any of my new team for a couple of weeks. I'm sure there'll be a protocol in place at all HAs, as it's usually the claimant's local hospital that they have the trouble with, so this situation must arise now and again, but i can imagine that in reality it's a bit of a can of worms...

whats the update with ds? has he had diagnosis yet? mri etc?

we moved hospitals when we had this, i don't know if it made any difference, but i didn't feel right being treated by the same place we were takeing action against

Sorry 2shoes and trib, I somehow missed your messages earlier. doh. Thanks for the link trib, I'll look at it in a bit. It's good to know I don't have to use that hospital, but the main thing I'm worried about is how this might impact on being referred to local cdcs/therapists etc. For instance I didn't have access to the therapists and cdc near me until I was referred away from the hospital I had ds to my local HA, even though they're both in the same county.

misdee, we haven't had a reappraisal yet, but I don't see the provisional dx changing much yet as ds hasn't really moved on from when the initial one was given. I hope it stands really, because I'm just (trying) to get my head round ataxic cp and know that it's not the worst dx it could be. Don't know about an MRI yet, and don't know who my new paed or neuro is yet.

Lou, my sentiments exactly. Did you find that moving hospitals had an impact at all on what you were offered in terms of local support? Did you feel as though you were able to access everything you needed?

ntt just wondered if you are making a case against a hospital and they haven't been sent the intention letter(sorry can't think what the legal term is) do the hospital know you are looking into a case??

I don't think they will know yet 2shoes, and I'm not sure how long it will take for htem to be notified. But I don't have to go back there now anyway as we've now been referred back into our local area. I just hope they don't "lose" my notes or interfere with them.

All this is such a head f**k why can't everything just be normal.

sure I have asked before but where do you come from. I am in brighton so to change hospitals would have been major. To be honest dd hasn't needed to go to the "one" excepr for mri and ent.

have you got your notes yet?

we have had a case underway, i can discuss it now because it is over. But from what i remember it is better NOT to use the hospital. My friend also lodged a complaint after a lack of diagnosis for CF for 5 years and the hospital refused to treat their son. It does make things more difficult, it shouldnt but it does.

Did you have a traumatic birth with your son? we were granted legal aid for similar reasons

I'm in N Surrey. Nope, no notes yet. V traumatic birth. I guess you didn't get anywhere with your case? I'm shocked for your friend Pkp, that's just awful.

"ours" is still on going so positive vibes please. It just seems to take forever just waiting to get rports done. but I am still hopeful.I come from Surrey Nr Leatherhead.
