ABA tutor contracts

Do you have contracts in place with your ABA tutors?

yup,

for us it was mainly to stop them taking the piss when it comes to holidays etc as they are self employed so without a contract they could take as much time off as possible without any notice... the downside is that you do have to agree to compensate them for any time off you book when they are working if not agreed in advance.

Found this on the internet. Some of this seems very "business like" to me, but then parents are telling me you have to be quite serious about this with the tutors. You all have such contacts in place? I have tweeked it a bit.

TUTOR EXPECTATIONS

Description:

? Carefully follow through on programming using ABA techniques and the Behaviour
? Consultant?s recommendations
? Be prepared to play, make believe and have fun
? Provide your own reinforcements
? Accurately track data at end of each shift
? Must be team player and accept feedback
? Must be respectful towards Behaviour Consultant, therapists, our child(ren) and other family
? Members
? A month commitment to our team
? Rate of pay is £
/hr and will be reviewed after a 12 month period

Training:
? Attend Basic ABA Theory and/or Line Therapist Workshop
? Subsequent training is provided in our home
? Additional support and/or training may be provided upon request
? Rate of pay for training days (6 hr sessions) is £__/hr.

Team Meetings:
? Team meetings are held on a monthly basis (approx 3-6 hr each) run by the supervisor.
? Team meetings are used to implement new programs and maintain consistency among team members
? Team meetings are scheduled one month in advance
? The Behaviour Consultant or family may request bi-weekly meetings
? Please do not miss any meetings ? they are vital to our child?s success
? In the event that a meeting is missed, it will be video-taped and must be viewed prior to your next session

Scheduling:
? Sessions are 3 hours (working one-on-one with child )
? Sessions are scheduled 2 weeks in advance
? If there is a scheduling conflict, please find someone from the team to cover your shift in advance and communicate the change to the parents. Or please let the parents know a week in advance if you cannot come for a session, so that they can arrange a replacement.

Time-Keeping
? Please be punctual for your scheduled sessions and monthly team meetings
? Please record each session and hours worked on the Daily Service Record located in the binder
? A summary of your hours worked along with your paycheque will be provided at month-end

Feedback:
? Feedback will be provided in writing to the therapist, parent and Consultant
? Regular feedback is crucial to our child?s success
? Videotaping may be conducted for the purposes of training and assessment.

Confidentiality:
? Please do not discuss our child, family or our team outside our home
? Please do not discuss other teams in our home
? Your discretion is very much appreciated

Concerns:
? Please feel free to contact either the parents or the supervisor if you have any questions or concerns about the program, behaviours, etc.

Termination:
? If for any reason, your goals change and you decide to leave the team, please provide a month?s notice of your intentions. This will provide the family with adequate time to find a replacement
? Reasons for dismissal would include: concerns around reliability, compromising our child(ren)?s safety, lack of effort and not taking into consideration and following feedback provided by the Behaviour Consultant and/or Lead Therapist. A month?s notice will be provided.

Employment Status
? You are not an employee and we are not an employer. You will function as a self-employed contractor. This means that we will not deduct any tax or NI from your pay cheque. It is your responsibility to submit your earnings every year on your income tax form. We will not supply you with a pay- slip.
? As a self-employed contractor, you are not entitled to such benefits as sick leave or vacation pay

Must admit I never did a single formal contract

Neither did I. But then I was lucky enough to get most of my tutors through personal recommendations so I wasn't too worried about their conduct etc.

Tbh there is a dearth of great tutors out there and if I found one I didn't see them as an employee in that way...I was more privileged to have them working with my son...and it would have felt quite aggressive to present them with a contract like the one above. We discussed terms (on both sides!) when I hired them and that always worked fine, while preserving goodwill which to me was all important.

The reality is that if they're fab, you probably need them more than they need you! And also if they break the terms of your contract (giving less than a month's notice etc) what are you really going to do?

googlyeyes - That is what I mean. Its so business like for someone coming and working in your home with your child. And nothing you can do about them breaking the terms of contract anyways.

To be honest, good luck if you are able to retain any good tutors with such stupid contracts. Google eyes is correct. You should try and maintain good relationships with your tutors.

I agree Nupur. However, you might be left short changed if you train a tutor and they just go walk-about. I can see a place for a contract, whether you call it stupid or non-nonsense is up for debate.

I am using a tutor who I have had working with my daughter for over a year and I doubt I will present her with this contract. But the others, I am still in limbo
