tribunal - panic mode - witness just phoned to say shes not coming and she crucial

my OT just phoned to see how htings are going. she also has the NHS report so was phoning to say that there is no disagreement at all in the reports etc etc. she was goingto come and she him again at beginning of january to do an updated report but then said that as both reports are in agreement there is no real need as such and i could save some money! then ii just said in passing about her coming in feb to the tribunal and she dropped the bombshell that she thought i didnt need her anymore and shes on a course now when the tribunal is. i have never said i didnt want her to come - she my most crucial witness but obviously somewhere along the line things have got muddled! im now in a blind panic - i know both reports are in agreement buit just feel like she should be there. she did say that she probably isnt needed so why do i feel like she is. she is going to speak to her boss who has attended lots of tribunals to see if she can come instead which will mean she will have to see and meet joe - this owuld have been my OT first tribunal and her boss did in the beginning offer to do it. think she thought she would get an offical letter instead of it just being word of mouth from me - maybe its my fault - this is my first tribunal as well! please reassure me its going to be okay............

Well, find out if the OT actually would be prepared to come if it was on another day, and then, if so, you can make a request to the tribunal (copy in the LA) that the date is postponed. Not brilliant but if you really do feel you need her there then you might have to do this. The tribunal 'should' be prepared to find you a new date, but it will depend on the LA agreeing, - which they SHOULD as it will be the elephant in the room if it goes ahead without the OT that could have come had the LA not been unreasonable iyswim.

I'm thinking that maybe if the worse happens she could come and do a further report in January as she last saw him in April and NHS OT saw him in sept so my report would be the most up to date . There is no disagreement in the reports , both say the same thing and agree with each other. The NHS OT is inexperienced with tribunal and is actually an okay person as she is my elder sons OT as well. I have an ed psych coming and she backs up the need for specialist provision as well on the education front and also agree with everything in both OT reports. I really do not want to postpone it as he's been out of school for 6 months at this point and needs to get back to school full time. If I'm brutally honest having 2 OTs there is going to be overkill - if they disagreed then I would want her there
