Information Commissioner - another day, another useless oversight body

I complained to the ICO as our dreadful hospital Trust refused to send me DS's records for 8 months because I wanted details of a meeting held, in my absence and without my consent, in which they stitched up their evidence for Tribunal with the LA.

Lots of shenanigans and denying such records existed etc. Lots of lies about how the meeting was just to through the Tribunal procedure and there was no record.

Eventually, I get a record - 8 months later. If confirms they discussed DS and the 'areas of dispute'.

ICO says:

  1. They were outside the time to provide records under DPA (do you think?? Hmm but they were confused and didn't realise it was a DPA request - despite the email saying 'this is a DPA request'!
  1. It's impossible to confirm what happened at the meeting but even if they did discuss DS, they might be able to rely on an exemption meant for legal proceedings. This is not of course something advanced by the Trust who, in fact,, say there was no record of a meeting.

So, here we go again with another challenge. These people should be ashamed of themselves.

Wow - really useless. I was hoping they'd be better than the LGO but only because I read that they did give bigger fines.

Don't know how you carry on AE but have to say thanks for doing so because someone has to.

Btw, are you working out your notice?

Trying - it's dreadful isn't it? There were only two points to my complaint and they missed out half of the second point. Making excuses for Trusts that don't even advance them for themselves is unacceptable

Have finished - paid in lieu!

My old GP "lost" 4 years of my son's medical notes (would have proved my point re his ASD much, much sooner!). I've just changed GP (different PCT) and will be watching with interest to see how the new GP fares in obtaining those missing four years (deliberately chose a practice that's quite thorough iykwim in order to see how someone else gets on with fighting this battle). If changing GP doesn't encourage them to spontaneously appear, then I'll step it up a notch.

I'm going after all his educational notes in the next few weeks too. I specifically want some video from his previous school that I'm not supposed to know exists.
