Have an ongoing complaint and would be grateful for advice on this.
Statement says that x hours of support are provided but that if any further support is required it is to be provided by the school. School did not supply extra support but instead placed child on part time hours that matched the sm for almost a year. Full support was only provided when further funding was agreed by LA as the school said they would not have child back full time without the funding.
I think the LA are responsible for failing to provide the provision on the statement and a full time education but they claim that school acted in best interests of the child and any complaint about their decisions should go to the governors. Are the LA fobbing me off on this?

Well the LA are responsible, but if the school said PT and you went along with it and the LA didn't know about it then there isn't much they coukd have done.

LA knew about the pt hours from the start and are supporting the school. Sm is being rewritten now provision has increased.

Yes, they state that although he wasn't in full time education he did receive an education and was not permanently excluded. Part time timetable was part of a PSP (generally a maximum of 16 weeks). Case worker was aware that we were unhappy about it.
School had said that he was likely to be permanently excluded which was why we agreed to the reduced hours initially.

i think that they are probably fobbing you off. if the original statement stated full time support then it is not your issue how it is finded - the lea is ultimately responsible for ensuring that the statement is adhered to - complicated about the part time hours. If you feel strongly about it i would lodge an offical complaint with the lea - you will probably get fobbed off again at the level 1 but then go to level 2 and they might take more notice. is he back in school now full time???? complaining does take a lot of energy and it depends if you have the energy to see it through
