Are there any consequences for the school?

I requested my son's school records 23 May from the chair of governors so I should have received them last Tues but I haven't heard a thing. Do I inform Ofsted that they've broken the law or do I write a stroppy letter to school or are there no consequences for the school? Deadline for Tribunal Appeal was today so it's lucky I wasn't relying on getting the documents in order to appeal :)

Also on Tues there is a special jubilee day when the kids are going to record their learning journey, hopes and aspirations in PHSEE lesson. I've just spotted that my very unhappy, dyslexic ds has an appointment with the deputy head during this lesson, should I write and ask them why?

Although you are probably better off complaining to the chair of governors about their legal duties, the time it will take to complain to anyone else and for them to investigate.

I would want to know why my ds had an appointment with the deputy head.

Would also add you would probably find some little gems on school file to help with your appeal, hence the delaying. I would focus more on getting my hands on the school file.

I know I was looking forward to seeing what was on file. I'll write to the chair of governors regarding records and I'll also write to the deputy head regarding her meeting with ds. There just seems to be no accountability in these situations.

There isnt any accountability, which is why i wouldnt bother complaining to anyone official, just threaten to! You have enough on your plate with the appeal etc, you dont need any distractions.

I found plenty on ds's school file to help with appeal, although same thing happened i didnt get school file until after appeal. I knew exactly why, when i did receive it.

Put all your time and energy into getting your hands on school file, complain after if you feel the need.

Daisy, you can probably submit anything relevant from the file as late evidence with the reason. An alternative is to take the document on the day and talk about it, even read it out!

I rmember someone said that when her school would not let her private Ed Psych into the school grounds, she got SENDIST to order it. Perhaps you could ask them if they could order the school to comply with your request.

Certainly do what Agnes said re:information commissioner's office.

And yes, you should write and ask why and how long your your child's appointment is on Tuesday and whether it will affect his participation of the special jubilee day.

I dont think there are any consequences Daisy, When I removed Dd3 from her school I wrote to both the LA and Ofsted, Ofsted wrote back and said I should speak to the LA and the LA said I needed to complain to the Governors. I didnt bother because the crap HT has the Governors in her pocket.

I think there needs to be some way for HT's to be accountable, it is scary!!

I would ask for your Ds's meeting to be done at a better time, maybe during assembly or something equally useless!

Thanks for your comments. I rang the LA but they do not get involved with school records as it is dealt with by the governors. I said to LA it's the governors that haven't given me the records, she could see the problem but would not get involved (no surprise there). Information Commission were really helpful, I filled in the complaints form on-line, attached the doc's and away it went, 20 mins well spent. Then I forwarded the complaint and attachments to Ofsted. Then I informed the school via email. All in all a good day I think. oh I'll ring SENDIST, what a good idea. I can't wait to see what's in the records that is causing so much trouble :)

I emailed the deputy head asking why ds was being 'withdrawn' from the event on Tues, I received a reply saying that he wasn't being withdrawn. I photocopied his diary with the meeting written in just in case I want to use that at some point. It's all fun and games at the moment.

SENDIST said I've got to wait for my case number and then I can make a request for the Tribunal to direct the L.A. to get my records. I did say that the LA had already told me that they don't get involved but she said the Appeal is against the LA and therefore they are the ones who would be sent the request, mmmmmm interesting. Conclusion seems to be that the LA can get the school to give me the records after all.

What an inspiration! You go girl!

The LA employ the staff (if it is a community school) I think they have some say about practices like this!

What about a letter to director of childrens' services?

Day of paid employment yesterday halted the march forward but today I've written to local MP, Mr Gove and Sarah Teather. Sounds a lot but emails make light work of attaching documents etc. I've received my Tribunal case number but I'm a bit disappointed as I will need to print off the request form, fill it in by hand urgh, and then post it - how old fashioned is that, gosh I'll have to buy a stamp as well! Oh, I have to send LA a copy - 2 stamps!

Director of children's services - hey why not : )

You can hand deliver to LA and get a receipt.
